ILR SET (M) Financial impact due to COVID 19

Post by wandali » Thu Mar 11, 2021 8:00 pm

Hi guys

I was wondering if anyone could help me. My husband visa runs out in May 2021 and is due for ILR SET(M). Since I was the one sponsoring him but I was made redundant in March 2021 until now I haven't been able to get a job but prior to that I was earning £23K which was sufficient for his visa and I can provide the 6 months payslips prior to being made redundant.

Could someone please let me know if he can still apply for ILR SET(M) based on 'Coronavirus (COVID-19) concession' which states
"a temporary loss of employment income between 1 March and 31 May 2021
due to COVID-19, will be disregarded provided the minimum income
requirement was met for at least 6 months immediately prior to the date the
income was lost - this is for a loss of employment income between 1 March
2020 to 31 May 2021 due to COVID-19 an applicant or sponsor furloughed
under the Government’s Coronavirus Job Retention Scheme will be deemed
as earning 100% of their salary"
and if so has anyone done this and what documents did you submit and if this doesn't apply to him what other visa route should he use?
thank you

Changes to the minimum income and adequate maintenance requirement
If you’ve experienced a loss of income due to coronavirus up to 31 May 2021, we will consider employment income for the period immediately before the loss of income, provided the minimum income requirement was met for at least 6 months immediately before the date the income was lost.

If your salary has reduced because you’re furloughed we will take account of your income as though you’re earning 100% of your salary.

If you’re self-employed, a loss of annual income due to coronavirus between 1 March 2020 and 31 May 2021 will usually be disregarded, along with the impact on employment income from the same period for future applications.

thank you so much for this.
Could you please help me with this question as I don't know which option I'm supposed to select as my payslips are not the same amount every month but my salary is above the financial requirement amount.

Have they been employed by the same employer for the last 6 months prior to the date of application? (Required)
Yes
No
What do they earn? (Required)
The same amount continuously, above the financial requirement amount
The same amount continuously, below the financial requirement amount
Not the same amount continuously, above the financial requirement amount

Hi, could you please let me know what I need to provide on the letter of the employer who issued the payslips confirming

1. the employment;

2. the gross annual salary;

3. how long the employment has been/was held;

4. the period over which the person has been paid the level of salary stated in their application; and

5. the type of employment (permanent, fixed-term contract or agency)

as I no longer work, should I provide a cover letter to explain this?

Thanks in advance

I think OP meant cohabitation documents. You need documents from 3/4 different sources evenly spread for the last 2 years i.e. every 3/4 months.

after uploading the documents, does he need to book an appointment to take the documents? Also is there a time frame or deadline of when you need to have submitted all the documents? is it when you have submitted the documents that count as the day you have submitted the application or when you have paid for the application?

Thanks in advance

The appointment is for biomterics and identity check.

Documents can be uploaded yourself from home. Documents must be uploaded before the biomtric appointment.

Date of application is the date you submit and pay for the online application. The date you submit documents or biomterics is irrelevant.

Steps to follow after completing the form online.
Depending on your category, you will fill the appropriate form online:

Step 1: Pay fee and submit application via UKVI ONLINE.

Tip: Date of application is the date you pay and submit online, biometrics date is irrelevant.

Step 2: After payment, you will reach “further actions page.” If you click on “book an appointment,” system will reroute you to create an account on UKVCAS where you can upload your documents and book an appointment.

Tip: You are sent an access code to set up an account on UKVCAS which usually lands up in Junk folder.

Step 3: Booking an appointment with UKVCAS.

You must book an appointment now. IDV is the past except T4. You get 45 working days after submission.

Tip: You are given a deadline to submit your biometrics on the further actions page. Since the backlog for biometrics has subsided, you should meet the deadline.

Step 4: Now you can submit your documents to UKVI via UKVCAS portal even before your biometrics. The option usually appears when you have uploaded all your documents, sign out and sign in again. The option can be found on the “document upload page” right at the bottom.

Note: Self-submission is OPTIONAL. If you want to benefit from the new feature, you must upload and self-submit up to 48hrs before the appointment. If you do NOT want to self-submit, you can upload ANYTIME before the appointment date and submit at the appointment itself. Self-submission is recommended as you may save some processing time - your documents are sent to UKVI even before biometrics in this case. You can self-submit only ONCE. But if you forget to upload any documents, you can always upload later on (after self-submission) and submit at the appointment then (you will not be able to self-submit again but can submit at appointment again - UKVCAS staff will do it for you).

Read “self-submit” “submit” “upload” separately.

Tip: The best approach would be to benefit from the new self-submit feature.

Step 5: Once the process as stated above is completed, you should wait for a decision.

Suggestion for booking biometrics appointments, might be helpful to new users:

You have 45 working days to book an appointment (excluding Sat/Sun) after online submission. These days biometrics appointments are running at a 28 days lag i.e. you get an appointment for the 28th day unless you get to find an earlier cancellation.

My suggestion:
1) Login UKVCAS booking system 12 AM midnight GMT to look for appointments.

2) Look for different centres and locations if you are willing to travel.

3) Look continuously for 3/4 days regularly (after submission and before booking a slot) to find an earlier cancellation or free appointments during the day/after midnight. For free appointments look especially between 6am-9am in the morning. Free options are offered by Core Centres only (week days).

4) If you fail and can not find any earlier cancellations or free appointments for next 3/4 days after submission, book one logging in at 12 AM midnight GMT. You will get one for the 28th day (has to be a week day for better availability). If the 28th day is a Sat/Sun, availability will be almost nil.

I would suggest you try your luck for 3/4 days before you book one. Once you book an appointment, you will not be able to see any more availability.

Thank you so much for clarifying this. He has had a look all he is getting are charged appointments (Liverpool). He will try again at the suggested times
