ILR Skilled Worker or Global Talent Dependent - Question

ILR Skilled Worker or Global Talent Dependent - Question

Dears,

I hope you all are alright.

I have been dependent on different types of visas since September 2018.
My husband was a student on Tier 4 visa and my first dependent Visa was PBS Dependent Leave to Entre from September 2018 till March 2021.

My husband switched his visa to skilled worker visa on March 2021.
I have also switched to Skilled worker dependent on March 2021 and my skilled worker dependent visa will expire 2026.

My husband switched his skilled worker visa to Global talent visa December 2023 and he got ILR recently March 2024 on three years route.

From my understanding (Correct me if I am wrong, please), I am eligible to apply for ILR and I can combine my 5.5 years of dependent visa (2.5 student dependent visa + 3 years of skilled worker dependent visa).

I have started filling the ILR Set(O) application however, if I choose "Skilled Worker, Tier 2 or International Sportsperson dependant" the following questions related to my husband current UK immigration status do not have the correct visa options. In another words, it only shows Tier 2 related visas' options.

The main question, do I need to switch my Skilled worker dependent to Global talent dependent and then apply for ILR after getting global talent dependent?

Is any way to apply for ILR, considering that I am eligible now, without switching my dependent skilled worker visa to global talent dependent visa?

You should have applied for ILR with your husband. Under the Global Talent rules, you simply need to have been a dependent for 5 years to become eligible for ILR. The type of dependant visas you held does NOT matter at all.

When applying for ILR, you must choose the Tier 1/Global talent dependant option, NOT the skilled worker dependent option. :!:

Thank you very much for your reply. He went for the supper priority service and paid extra £1000.
Additionally, I was not sure to apply with him since he has chosen a different route.
Can you share any guidance, if you have, that could help in case other questions raise up while filling the application?

You could have applied at the same time either with him or separately. As I explained, your dependant visa route does not matter if you are applying for ILR as a dependant under GTV rules. The form is usually self-explanatory. Ask any questions here and we will guide you along the way

First of all,

I would like to thank you for your help and clarification.

I have filled the ILR set (O) application and submitted today.
Apart from the " Consent form for the Home Office to request verification checks", another document "Declaration signed by my husband to confirm consent for the Home Office to request verification checks" is also required in the check list.

I have downloaded the consent form but there is no such document called " Declaration consent form ", is there?

Can my husband write the document himself and sign it? would that be acceptable? or there is a standard declaration form that he needs to find and sign?!

Initially, I had the same though but it is confusing me a bit now as in the check list there are two requests for my husband to do.

First one it says "Consent form for the Home Office to request verification checks on for joint accounts or third party support"

The second one says "Declaration signed by my husband name and title to confirm consent for the Home Office to request verification checks"

Singing Part 2 by him would cover both requests?
