Hello brother, first of all sorry brother to bother you again about my ILR 10 years long residents matter. I already told you everything about my case earlier. My ILR was refused coz home office said I had a out of time appeal in 2015. Home office refused me 2nd march 2015 and my solicitor received that letter on 23rd march 2015 and he lodged the appeal on 31st march 2015 so home office refused coz it exceeds 14 days time. When last month I explained you everything you said to me to contact with the tribunal who dealt with my case on that time whether it was an in time or out of time appeal? You said that as well may be you solicitor gave a good reason of late appeal and court may be accepted that. Actually you are absolutely right. I phoned with my lawyer to the tribunal and they said it was counted as an in time appeal on that time. Now last two weeks ago my lawyer applied under the pre action protocol again and explained them everything that we did spoke with the tribunal and mentioned the name who I spoke and time as well with the date that it was an in time appeal. My lawyer gave the evidence as well the letter with the stump from my previous lawyer that it was received late and also the appeal form copy as well where he clearly mentioned why he did late appeal and requested to accept it as an in time appeal.
Today home office gave reply that they are reconsidering my case and they said within 3 months they gonna get back to me again so they said just wait patiently. So what you think do you think is it a good sign or I have to go to the JR?
Coz I can’t wait 3 months already 5 weeks gone of refusal and JR should be done within 3 months of refusal I think. Do you think I have to go JR?
And I spoke with the tribunal they said it was an in time appeal even though we mentioned everything to the home office but didn’t give any paper proof that it was an in time appeal, do you think they will contact with the tribunal to confirm that?

Ok great. If they are reconsidering then that means they have taken the refusal decision back. I advise getting a confirmation from the tribunal but the UKVI will probably do this during the reconsideration. Going for JR is not advised as now you have a pending application again

Thanks you very much brother for your kind information and the way you gave me suggestions I think that’s great. Not even a good lawyer can’t do that. So do you think they said they are reconsidering my case and took 3 months time means they take back my refusal decision? And is it a good sign? And another question is should I wait for their decision for at least three months or after one n half month I should lodge JR coz lawyer said from the date of my ILR refusal within 3 months I have to do JR so already 5 weeks gone so shall I will for their decision another 6 weeks and prepare for JR? Or shall I wait another 3 months what they take for reconsidering my decision?

Reconsidering means they have taken the previous decision back and they will give you a new decision. As I also mentioned before long residence is a human rights application and must confer appeal rights. I suggest to hold on for now and wait for the decision first

Thank you very much brother I got ILR biometric card. Thanks for your useful information and inspiration to fight back. Thanks from the bottom of my heart.
I have few questions now
1) I haven’t received my approval letter yet it’s been almost 10 days I got the brp card do I have to send back my old card if so which address kindly please tell me?
2) secondly now I’m going to apply for my daughter’s naturalisation through MN1 but problem is the two referee for child first referee should be a professional one like school teacher, doctor, social worker but I asked everyone nobody now don’t give what should I do? Shall I give from an accountant as a first referee?
