Yes the ACPO check should be akin to the police station PNC check. If your LC20 was issued by the Police and did not involve the courts it would not be a conviction and thus not a general grounds for refusal.

Thanks for reply Amber.

From speaking to DVLA and metropolitan police I gather following information. I have acknowledged my fault immediately after police officer convicted me and paid relevant fixed penalty (£60) issued by police officer and returned my counter part to relevant authority. Points were endorsed by 'London Collection & Compliance Center' which is part of HM courts but there was no trial or conviction in court, rather this body was responsible for concluding and endorsing points on driving license counter parts. (I think most cases this is the procedure. No police officer endorse points on counter part of license, though I heard there is new regulation came last month or so.. stating that police officers can endorse points to cut admin process involved)

From my driving license counter part, I can also see that Conviction and Fine section was striked off for above endorsement and remarks clearly says 'Fixed Penalty' So i came to conclusion that this was a fixed penalty and no court conviction or fine was involved.

My Basic CRB came clean too.. waiting for ACPO PNC check results (finger s crossed!!)

Hi All
My ILR got approved today at Croydon PEO.
Back ground of my case: I have 3points on my UK license endorsed on 24 Oct 2011 for LC 20 / conviction code 2665.. however my license counter part clearly says its a Fixed Penatly and court conviction section is clearly striked off.. I have spoken to DVLA and Metropolitan poilice.. they all confirmed that there was no court conviction as I accepted fault and paid Fixed penalty £65.
In application I have declared above in criminal conviction section.. but as this is a fixed penalty case worker might have ignored this issue.
Thank you very much for all the moderators and senior members for your guidance.
Many thanks

Yes as I suggested, an FPN is not a general grounds for refusal as its not a conviction, akin to or an admittance of guilt.

Re: ILR & TRAFFIC OFFENCE

Post by w8in4response » Fri May 30, 2014 10:36 pm

I have applied for ILR under 10 years long residence category.

I received three points on my license and £60 fine on 26/11/2012.

At the time of filling application SET (LR) under the civil penalty question I was asked :

E4. Give details for each civil judgment or any civil penalty under the UK Immigration Acts,
starting with the most recent one. If you have received more than two civil judgments and/or
civil penalties under the UK Immigration Acts, please photocopy this page and enclose it with
this form.

I wrote that I was given three points on my drivers license and attached copy of the counter part with the application.

The confusion I have is that I have mentioned getting three points on my license but forgot to mention that I had paid £60 fine as part of this fixed penalty.

Is this going to have any affect on my application or mentioning about my three points penalty will suffice the requirement?

Thank you in advance.
