Immigration Form to Use - Dependant Visa

Post by danlily » Wed Apr 07, 2021 3:35 pm

Hi

My husband was on Tier 2 (general) visa and shifted to ILR in 2017

He became a British citizen a year later in June 2018

I joined him on a Tier 2 (general) dependent visa in March 2016

I extended my visa in June 2018

I am now eligible to apply for ILR.

Which form shall I use?

SET O or SET M

Form SET O if you have held a tier 2 dependent visa for 5 years.

Re: Immigration Form Set O - questions

Post by danlily » Thu Apr 15, 2021 9:55 pm

Thank you for the clarification. Can you please assist with how to respond to the following questions in the ILR application set (O).

1. Does the period of stay on which this application was based include any leave granted since 11 January 2018?

2. Have you previously lived in a country outside the UK including your country of birth?
(What to answer if I have stayed in Pakistan for 27 years including a visit to the UK and USA.

3.Do you have any Home Office reference numbers? (I have not made an ILR application before)

4. Additional applicant?
I have a 2 year old daughter who was born in UK. Do I need to add her details to the application?
My husband is already a British National. I am making this application for myself only.

1. Answer is yes if you extended your visa in June 2018.

2. All countries you have LIVED. Not visited.

3. Any visa reference. It is an "if known" question.

4. No.

When I answer YES to this question the next question appears below

Which countries did you visit or travel through when absent from the UK and Crown Dependencies?
Does this include all holidays outside the UK from June 2018 (when my BRP was last renewed) or January 2018?
Or does this
mean the time spent outside the UK in the last 5 years? I arrived to live in the UK on 11th April 2016.

2. Have you previously lived in a country outside the UK including your country of birth?
I have lived in the UK while I was here for Masters in 2010-2011. Do I need to add those details?

Only absences from June 2018 when your extension was granted.

No harm including it.

How to answer on the question where it asks for my husband's current UK status

1.Which visa is Mr XXXX applying for or been granted?
Choose the route that MrXXXXXX has applied for or been granted, even if their application is still being processed.
(My husband is now a British citizen. Prior to this he held a Tier 2 (general) visa in the past.
Which option from the dropdown list should I choose?)

2. In the question that follows
VAF number
GWF number
I don't have either of these.

(Is it ok to say I don't have either of these?)

Documents section
Can you explain what this Q means
1. Is the account with a bank or utility company for which you have supplied information and supporting documentation held jointly by you and other people?

2. Does the account with the bank or utility company for which you have supplied information and supporting documentation relate to another person who is to provide you financial support?

Documents

Could you provide a list of documents to attach alongside application?
Do we have to attach proof of residence council tax?
Utility bills?

This is the list of documents I am getting
The passport issued for XXXXX (myself)
Other documents
Consent form for the Home Office to request verification checks on Mr (husband's) for joint accounts or third party support
The degree certificate for Ms XXXX to prove the level of English language required
Evidence of Ms XXXX immigration status in the UK
Declaration signed by Mr husband to confirm consent for the Home Office to request verification checks
Current Biometric Residence Permit for Ms XXXX
All previous passports, travel documents or national identity cards that you have used to travel to or remain in the UK

Another question:

Immigration Question:
Does the period of stay on which this application was based include any leave granted since 11 January 2018? Yes
Have you had any absences from the UK during any leave granted since 11 January 2018? Yes

I am then listing my absences

I was out of the UK in March 07 2018 - March 12 2018 (Switzerland for holiday)
I was out of UK from Dec 25 2018 - Jan 14 2018 (Pakistan)

Do I need to add these to my immigration absences or only the absences from 06 June 2018 when my BRP was renewed.

in the documents uploading section

do we need to scan the first 3 or first 5 pages of the passport?
also what about previous passports held? I have a previous passport which has a UK visa stamped on it. Do I need to scan that too?

Only biometrics data and travel data on passport pages, from all passports in the last 5 years

Question:

The consent form to upload are only 3 pages right?
page 1: consent for the home office to verify application form
page 2: consent for the home office to verify third party information
page 3: consent for the home office to verify information from third party sponsor

Can you please explain what is the difference between form 2 and 3
Also consent form 3 says with an asterik if the account is a joint account all owners should sign

what does this mean?

I am providing joint account bank statements for my husband and myself as supporting documents. Do I also need to put my name and signature both on consent form 3

Part 3 is when a third party is proving financial support to the applicant however in this case the dependant has no financial requirement for ILR. so part one is signed by the applicant and part two by their spouse/partner
