Indefinite leave to remain(ILR)- Long Residence

Post by TOUFICKKHAN » Wed Mar 11, 2020 4:48 am

Hi All,

I am looking forward to apply for ILR based on long residence i.e 10 years route. Below is my journey in the UK:

I arrived in the UK as a student on 15th of April 2010. I then applied for post study work Visa in Nov 2011. later I applied for tier 2 Visa in July 2013 and extended successfully in June 2016 for 3 years. My company then lost their Sponsor license unfortunately and my visa was curtailed in May 2018 and was asked to either find a new sponsor or apply for another visa by 31st July 2018(last day of Visa). Somehow, my girlfriend who was my dependent got a sponsor and I applied on 31st July 2018 as her dependent on tier 2 Visa. I got the Visa approved in Sept 2018(as applied via standard post) until Sept 2023. Since I am completing my 10 years on 14th April 2020.

My questions below:

1. Can I apply 28 days before the 10 years time? i.e apply on 16th March 2020(9 years, 11 months and 2 days) or after

2. I am filling out set LR form for the ILR? Correct?

3. if I am applying for ILR 28 days before the 10 years completion i.e 16th March 2020, do I need to submit the online application form on the 16th or after or I can submit today i.e 11th March 2020 and get an appointment date after the 16th March 2020? in short, is the date of application taken into consideration when applying for ILR or the date of appointment when the caseworker goes through the case? I am going to apply using the super priority service.

4. On the Set LR form, there is a question "How long have you lived in the UK"? So if I am applying 28 days before the 10 years, can I choose 9 years and 11 months? as you can only choose months and years on the application form and not the days?

Look forward to hear from you soon.

Many thanks,

Indefinite Leave to remain(ILR) based on 10 years - Checklist

Post by TOUFICKKHAN » Wed Mar 11, 2020 5:23 am

Hi All,

can anyone who have recently applied for ILR based on 10 years share the checklist? I need to ensure that I am not missing out on any thing. Mandatory documents required for me are below:

evidence to Prove relationship with my Girlfriend
evidence to proof my relationship with my girlfriend
biometrics or passport of my girlfriend
my passport (current and old)
my biometrics

now, I am wondering why would they need documents relating to my girlfriend when I am applying for ILR on my own? Also, like other visa categories, we had to show funds in the bank. isn't there any requirement to show funds for ILR?

can anyone help here please?

thanks,

1. Yes
2. Yes
3. Submit on the day you are eligible for ILR
4. That question is not important. 9 years and 11 months is fine

None of those relationship related documents are required. Long residence ILR has nothing to do with your partner as you must qualify on your own and your relationship status is not relevant. The doc list is generic
