Indefinite leave to remain Victim of domestic violence

Hi I came in Uk as a student visa after that I got married British spouse then I move to spouse visa, I got my first 2.5 years visa but before my visa expired my wife physicals assaults me punched me, then I called police, police came ambulance came, I have one British son as well, my visa expired next month what should I do. Also I went to gp told them everything they refer me domestic violence team..which visa I can apply please, if you guys let me know I will more appreciate

You can apply for ILR based on DV but you will need evidence to support your application and you must apply before your visa expires. Note that these applications can take a while to be decided but you won't be an overstayer if you apply before your visa expires.

You could also look into FLR(FP) parent route based on your child but will likely be a 10 year route, 4 x 2.5 year visas, to ILR. If you have evidence and support for DV, I would do that one.

No due to domestic violence incident I live different address, that day I called police, police said tendency aggrement by my ex I can’t live with her, I’m on spouse visa my Visa gonna expires on 25th January 2018. I have evidence like:

1.I called police tell them my wife punched me, that gave me victims support card( investigation follows)

2. Report to Gp domestic violence, go refer me domestic violence team.

3. Gp latter.

4. Police called ambulance due to I cannot take breath in, ambulance came all paramedics they done, I have ambulance report.

5. Life work independentl organisation help for employees.

6. Manager latter , next day I went to work he saw bruises eyes, swollen, I explain for what happened, he wrote latter and mentioned all innocent what he saw.


Do you think is it ok if I apply for indefinite leave to remain victim of domestic violence

That should be sufficient if you have all that evidence and give ILR a try.

No one can say what your chances are. It really depends on your circumstances, evidence and history of the DV.

These applications can take many months to be processed.

It is up to you if you wish to apply in another category based on your child.

People do get ILR based on DV. Many who do apply don't necessarily post on a public internet forum for fear of their abusive spouses finding out.

There are not many queries for this route on the forum at all.

Hi I done my biometric last 26th November 2018, but I didn’t heard anything from Home Office, my question is how long normally waiting time for domestic violence visa , I feel stressed .

Hi guys I got a latter from home office last week they ask for police report however I apply to get police report but I didn’t get yet, home office said I need to give them before 26 feb, also they asq for MARAC report but I had a interview with Lock Ahed team about domestic violence they give a a support worker but my question is if I give my support worker later is it ok also I bar children social worker report as well, please guys can you suggest me anything what should I do

There is no set time frame. It varies on each case. Best is to stay positive and wait patiently.

please let me know as I am also a victim of DV and I have submitted my application on 25th of April but until now I haven't heard anything yet and I am very stress and afraid of what will happen to me after this.

please update me if you receive any feedback from the Home Office with regards to your application.

I got a latter from home office they refused me then I done administrative review I received a latter yesterday I win admin review they said they gona withdrew original decision, bcz they found some errors by home office. But I’m worried what will be next. I success my admin review

I did receive a letter from Home Office asking for MARAC when in fact my solicitor submitted it and she submitted it again. Since then no news.

How about you, did you submit it? How many weeks did you wait after you submitted the requested document to the Home Office before you receive the refusal?

Apart from MARAC, did you submit a letter from the organisation who is helping you?

What are the grounds for refusal? If you submit everything how come that the Home Office refused it?

You can call them for an update about your application if you have won the case.

They refused me same grounds but I got a court latter for child contact I’m doing again administrative review let’s see how it goes
