Re: Long Residence (10 years) SET (LR) applications

Post by rony1981 » Fri Oct 12, 2018 2:07 am

Hi all,

I am new to this forum. I have appointment on 31st October in croydon PEO at 8.30 pm. I entered in Uk on 10th of October 7.40 am. My immigration history is as follows:

1) October 2008 - April 2010= General student visa. After entering UK, I found my college is dodgy college and I did not attend it after two months. I got enrolled to another college( I have enrolment letter, Certificate). Home office sent me letter about the reason for not attending the college. I sent a cover letter with new college enrolment letter. On that time TIER 4 rules were not introduced.

2) April 2010- August 2011= Tier 4 student visa for Msc in University of East London. My visa was refused initially due to maintenance ground with appeal right. It was misunderstood by Home office. I won the appeal in Feltham tribunal without the solicitor help and granted full visa.

3) August 2011- August 2013= Tier 1 PSW visa.

4) August 2013 - September 2015= Tier 4 visa for MBA in Anglia Ruskin University.

5) September 2015 - September 2020= Tier 4 Visa for PhD in Anglia Ruskin University which is currently I am holding on.

I was outside of UK for three times altogether 90 days and was never overstayed. I have dependent wife who also granted visa from back home when I was doing MBA. She also have the visa now till September 2020 as my dependent. And We are blessed with a baby boy who is 2.5 years old.

Now as far I know, once my ILR is approved, my wife and my son will transfer to FLR(M) and Naturalisation (MN1) subsequently.

The documents I am considering to submit as follow: (including photocopies)
- All passports including current biometric.
- Life in the Uk
- Masters certificate
- Application from
- Two photographs
- Letter from University
- Cover letter

For cohabitation, I will submit my wife BRP photocopy, one copy of letter of all addresses in uk where she lived with me, My son birth certificate.
Now my question is what is the probability of getting ILR? And any more documents I need to add.

It will highly appreciated if any of the experienced members please advice me. I will be really grateful.

Dear All,

I am trying in person premium appointment which I am failing to get one, from long time. I am planning to make postal application.

Regarding the documents, when I have filled online application at the end it listed documents which includes the passport and BRP card of Wife and kid's. I am not sure about sending the original for both as likely it could get stuck with home office for long time, along with mine which I dont mind as its my application.

One thing I noted that in front of some listed documents they have a wording 'Original/s' where as for other it is just says 'Document/s'. I would like to know is it necessary to send original documents of partner and kid. Please, any comments would be helpful.

In addition, I would like to know how likely the upgrade to premium service can happen ? Can I ask for upgrade within a week after giving BRP service ?

Many thanks,
Dinesh

Hi all,

Sorry to bother you. I have a question.

I applied my long residency visa in June 2016 and have had not got any reply from HO. I withdraw my application in July 2017 and left UK. I came back to UK on tier2 visa in October 2017. The question here is, can i re apply for ilr on the basis of 10 years or my long residency period has been broken? Do I have to complete 5 years again?

Kindly reply. And sorry if this is not related to this forum.

Dear Guru's and friends. My set lr has been refused after long waiting (1 year and 2 month). It was postal application and i put below of my immigration work history.

came january 2007 and successfully extention until january 2016 and in between all of this time duration i was student and psw. In 2016 i applied flr (fp) and than vary the application into set (o) and lastly applied the set (lr) before home office make my set (o) application. so their have no problem about my 3c and i fulfil my ten years.

they found 3 months working history while i don't have the right to work permission and homeoffice have the proof from royal mail and HMRC about this. on this ground they refuse my application and even though they haven't give me the in country right of appeal.
Than i submit pap against the decision of out country appeal right which home office refuse me. I went for jr And paper hearing which was refuse as well and lastly oral hearing of JR i win. Recently home office send me a consent letter where they said they withdraw the original refuse decision and reconsider and will make a new decision of my ilr application. My question is what u guys think wheather will they grant me a visa or again refuse me with in country appeal rights. Love to hear from yoh guys. Thnx

Hi
I've read through many posts in this forum which have been very helpful so thank you to everyone!

This may be a silly question but I needed to be sure....so from what I've understood For SET(LR) 10 years I do NOT need to provide bank statements?

Hello everyone,

Does the counting for 540 days outside of the country start backwards from the date of application?

I believe I have spent about 560 days outside so far, 100 of these in my first year in the UK. Just wondering if I can wait an extra year (apply at 11 years) to take my days outside the country back to below the limit (of 540).

Many thanks

Yes it does. Best to wait and to be clear, otherwise very high chance they’d reject u.

Hi All,

Received my ILR (long residence 10yr) through premium service in Cardiff.

Appointment 8:40am (arrived at 8:15)
Registration done at 8:30am
Biometric done at 9:25am
10:30am case worker said the documents are all fine but the approval from their security checks are still pending from the data base centre.
15:00 he said that we need to hold the application as they still didn’t received reply. We requested if we can wait another hour to see if thebreply comes. The case worker was very co-operative and helpful. He accepted our request and we came back after 45 mins and we received approval. (Lucky us)

Hope it helps.

Docs as follows;
PASSPORT & BRP
LIFE IN UK
MBA DEGREE
FILLED FORM
SOLICITOR LETTER

Still took all business docs and personal statement on side as my current visa status was Tier 1 E(full clean and running). Also I didn’t wanted to give them any chance.

Best of luck to all who are applying
Hi Satinder,

First of all Congratulations and thank you for the information you provided.

As I have got very similar case, I would just like to know what Tier 1 documents they ask you to provide.

Many thanks in advance!

Hello everyone,

I've read a number of useful posts on this forum and this thread in particular. So I thought of sharing my ILR(LR) application experience thus far.

I had to opt for the postal route as I couldn't find an appointment 28 days before the 10 year anniversary. This is despite the fact of getting up at 12 midnight to find available appointments. But I couldn't find any appointments in the next 45 days. After trying for over a week I found some which were 100s of miles from where I am based (Close to London), but they were after my current visa expires.

I would have waited longer and persisted with the one day premium service if I my current visa wasn't expiring. In the end, I had to no option but to proceed with the Online/postal route.

10/09/2018: Applied online - SET (LR).
11/09/2018: Submitted by BRP details and posted documents at post office.
12/09/2018: 8am: Emailed to apply for Postal to premium upgrade service.
12/09/2018: 10.33am: Notified that my documents have not been linked to my application yet.
9/10/2018: Premium Upgrade request acknowledgement changed from 5 to 10 days turn around.
10/10/2018: Permanent migration team, not Premium Upgrade team, notified that my application is still under consideration and they expect to make a decision within 6 months.

The wait is agonising to say the least.
Its compounded by the fact that I have a job offer away from my Tier 2 sponsored employer, but I can't take the new offer until I have my ILR.

I hope to preserve with the daily emails.

No. The form is very clear on what you need to submit and what HO expects to see if you do not have all your passports.

"Please state what social, cultural and family ties you have with:
the country where you were born
any other country whose nationality you hold
any country where you have live for more than 5 years
Anyone have any advice please?

What advice are you expecting ? The question refers to your personal connections - how do you expect others members to know your personal matters ?

Hi hw rose, I went along the lines of what family I have in countries where I spent a good amount of time and what my social activities were during my secondary, tertiary and post tertiary education years. For example, sports, cultural (music, drama etc) and professional clubs and societies. I assume even religious or any other activity would be fine.

Hi,
was reading guidance, and came to know that there could be possible two outcomes(grant) if we go for SET LR. One ILR, and second if for some reason they think, ILR cannot be granted, than they may offer discretionary leave 5 or 10 years route (parent/partner) depending on if a person has family/private life? is it true and has anyone got any story/articles here which i can read or if someone can share their experience?

Thanks

Respected Guru CR001,

I was filling online application SET LR form. To start with it was asking few questions, one of the question is as follows which concerns me and was not in paper form before.

You must include all your reasons for wanting to stay in the UK on this application. If you apply later giving reasons you could give now you may lose the right to appeal a refusal of that application. You can give your additional reasons in the space provided at the end of this application if needed.

Does this question do be worried much or shall i fill in as 'living for 10 years with job and family; baby born here and going to nursery; having house here etc

or are there any ideas [sample] to fill this please.

Also in the link below and last paragraph.

https://www.gov.uk/guidance/ukvis-new-f ... ed-to-know

Appointments at Premium Service Centres
From 29 November 2018 to 8 January 2019, for customers applying online for leave based on family life or private life who choose UKVI’s 24-hour decision service, there will be limited appointments available in the Premium Service Centres (PSCs) for those not able to use UKVCAS. During your application you will be advised about which services you are able to use.

The customers who can use this service will be those applying for leave based on family life or private life where one of the following conditions applies:

they have no extant leave
they are applying for the first time or are switching from an unrelated route
We will publish more information on this soon.

Would Long residence come under private life or NO!! As of the new visa system, is there any premium same day service where we can get results on that day itself? Sorry if it is too early to ask this.

I look forward for your reply as always.

Many thanks

Appeal rights have been severely. So if you think you qualify for an appeal, you need to include that reason here. HO is just pointing out that you can't do that later.

No, LR doesn't come under private life.

It appears that the same day service is no longer available. You can get a next day decision.

My question is Can I still use this old version application form ? or do I have to apply online ?

Thanks and would appreciate your response.
