Hello folk,

Im appying for ILR 10 year route, before I file it can you advise me on the following question:

Do you have any other reasons for wanting to stay?

It further states that appeals will only be allowed on whats stated here!!

Im looking for any tips on what to include.

Any help would be much appreciated.

Dear Experts,
I have been in UK since May 2010 and below are my details:
1. May 2010 to Aug 2011 – Tier 2 ICT
2. Aug 2011 to Aug 2013 – Tier 1 General.
Above 2 stays were in continuation.

My Tier 1 visa got expired on 18th Aug 2013 therefore, I had left the UK on 16 Aug 2013 and had applied Tier 2 ICT again from home country (as I was not allowed to apply new ICT from in country).
With the new Tier 2 ICT long term, I was back in the UK on 8th Sep 2013. Due to this, there is a gap of 23 days where I was outside the UK and without holding any visa.

3. Sep 2013 to Sep 2018 – Tier 2 ICT

Before expiry of above Tier 2 ICT, I had applied for Tier 1 Ent and decision is still pending. I have already completed 8.5 years in the UK.

Question - If I am able to complete 10 years of lawful residence in the UK, does the issue highlighted above (regarding a gap of 23 days outside UK without visa) will impact my eligibility for ILR long stay? One solicitor told me that since the gap is below 28 days therefor I am safe.
Kindly advise.

Dear sy5431,

Sorry unfortunately on 16 aug 2013 your continuous stay has ended . If you made any application within the country and got successful it would be counted as a continuous stay.

You are wrong and giving incorrect advice. The posters stay is not broken as they left the UK with a valid visa and returned within 180 days on a new visa.

I am 100% sure . I am not here to give wrong advice . I am here to help .

I am here since 11years gone through many applications, extendions, refusals , court appeals met so many Solicotor’s and consultants and frauds too.

Studying every single case is my full time job until I get my citizenship. Not to just help myself but others too.

Unfortunately, you are incorrect in your advice given about the break in continuous residence. See page 10 'Time Spent Outside the UK' in the link below.

https://assets.publishing.service.gov.u ... -v15_0.pdf
If the applicant had existing leave to enter or remain when they left and returned to
the UK, the existing leave does not have to be in the same category on departure
and return. For example, an applicant can leave the UK as a Tier 4 (General) student
and return with leave as a spouse of a settled person. Continuous residence is not
broken as the applicant had valid leave both when they left and returned to the UK.

Only if the below applies, also from page 10.
left the UK before 24 November 2016 with no valid leave to remain on their
departure from the UK, and failed to apply for entry clearance within 28 days of
their previous leave expiring (even if they returned to the UK within 6 months)

It is unfortunate that you did not spend some time to go through the immigration rules. It would have saved you the enormous effort you seem to have done doing everything else.

Will save you a bit of trouble and quote the relevant section of the immigration rules below.

Long residence in the United Kingdom
276A. For the purposes of paragraphs 276B to 276D and 276ADE(1).
(a) “continuous residence” means residence in the United Kingdom for an unbroken period, and for these purposes a period shall not be considered to have been broken where an applicant is absent from the United Kingdom for a period of 6 months or less at any one time, provided that the applicant in question has existing limited leave to enter or remain upon their departure and return,
My comments are in no way meant to be advisory. I have no professional knowledge of immigration. These are based on my own experience, convictions and personal interpretation of publicly available information.

Hello @ I_luv_IMMBOARD

When did you actually applied for SET (LR). And was this paper form or online? if online did you go to one of the sopra? and select premium/super priority?

Regards,
The OP has clearly stated that they applied on 8th August, clearly BEFORE the new system and likely by post if no same day decision.

This topic is NOT for queries relating to the new UKCVAS system and delay in decision. We have existing topics for such queries.

general-uk-immigration-forum/ukvcas-sup ... 5-420.html

general-uk-immigration-forum/new-appoin ... 7-340.html

Note that you were NOT required to provide all those documents for ILR LR. Only passports for 10 years required, LIUK and English, nothing else.

Hi all,

Here's my timeline:

I submitted my application through the new premium route on 11 November, booked appointment for 30 November in Manchester Central Library.
12 November: Received email that my application is submitted, I will receive a letter to submit my Biometrics and saying that decision may take up to 6 months. The email read as if the premium status of the application was disregarded. This made me a bit nervous but I thought it was just a generic automated email.
23 November: Received email (seeming an automated one) that I should have received a letter inviting me to submit my biometrics. Which again made me nervous as I was already waiting for my premium appointment.
23-30 November: I gradually scanned all the documents and uploaded them. fyi, I scanned all the pages of each passport (including empty pages) I had, and collated them separately. I had chosen the document upload check service but because I uploaded most of my documents just a couple of days before my appointment, I didn't get any special service.
30 November: Attended my appointment. Biometrics went very quickly and they rescanned my current passport even though everything was uploaded fine. This all took about 10 minutes. I went early and left even before my appointment time.
6 December: Received DX card and a Royal Mail card left as I was away. I rearranged delivery and received my BRP the next day. The letter explaining that my application was approved arrived later and separately.

I had to wait for about a week to hear the good news, I didn't receive any emails. Good luck to everyone and also wish everyone lots of patience and good humour in waiting...

hope all doing well ,

I have a question regarding the ILR(LR) for a friend of mine who had his Refugee state approved in February 2018 and been in Refugee state since then. but he had already completed 10 years long residency in October 2018 ,

he has been in a lawful stay in all 10 years except he had been waiting for his asylum claim for 3 years and few months before his claim was accepted and refugee state granted. he had no refusal during his asylum process just waiting for the decision.

Can he apply for ILR(LR) or it is a complicated process and risky step that might affect his refugee state he is having now.
