Hi,
My case is bit complex but i really need strong and special advise.
I came to UK in Feb 2007 as student.
I went for Holidays in 2008 for a month.
On 31st Jan 2010 I left UK as a student because of serious illness as I have all the UK medical Certificate.
On 30th Mar 2010 I came back to Uk but at Airport, Immigration officer stopped me and refuse my entry.
The reason - My course was finished but my student was valid untill 31st may 2010, so immigration officer told me that i can not enter on this visa and advise me to apply for PSW visa from India so they send me back to India on same day 30th Mar 2010. I gave them so many explanations that i was sick and i maintain the funds here in UK to apply PSW visa within the UK but anyhow they sent back me to India. I maintain the new balance again for next consecutive 90 days. On 1st july 2010, I applied the PSW visa and got refusal on 17th July 2010, the reason they mention that I didn't applied Visa with in time scale. But they were wrong, Than I applied for administrative review and got success. So I got PSW visa on 15th sep 2010 and on 23rd Sep 2010 I enter the UK. Now I am on Entrepreneur Visa but my 10 years is going to complete on feb 2017.
Now the fact is from 31st Jan 2010 to 23rd Sep 2010 is 7 month and 23 days
another fact is from 30th Mar 2010 to 23rd Sep 2010 is 5 month and 24 days (which is less than 6 months)
I want to know shall i go for LR or no?
Please advise
Sahib

Hi Sahib
As immigration officer didn't allow you to enter so your period of absence will be counted from 31 Jan 2010 up to 23 sep 2010. Your continuous period has been broken because you spent more than 180 days outside uk. Better go through entrepreneur route.

Thanks Awan for your advise!

Just in case if I apply for LR visa and get refusal. Does my Entrepreneur visa will be valid or Cancelled? I mean if I take a chance for LR visa and do I still have the option to apply as an entrepreneur visa?

Regards
Sahib

In case of refusal you can continue your stay with your current visa, it wont be affected. You can apply ILR through entrepreneur route later on when your 5 years will be completed.

Hi
To me, self employed and company director are 2 different things. I also collect information from different accountants. The preferable is if you also register as self employed but its not necessary to do. I didn't register as self employed and i tick on I HAVEN'T BEEN REGISTER AS SELF EMPLYED in question 3.
Further tomorrow one of my friend have appointment in glasgow centre for 10 year long resident, hope everything will be fine with him and let you know guys.

Hi guys,

I am currently on appeal and applied to First Tribunal to appeal in Upper Tribunal but didn't get it, now got 14 days to appeal to Upper Tribunal. But my 10 years have completed on 12th September so thinking to go on window for ILR (LR). But what if i get refused for any silly reasons, I would not get right of Appeal, What I can do next ?
And possibly what reasons could that be ? And what they check ? Thanks in Advance.

Hi,
I have an appointment for premium service on 02.11.2016 for SET(LR). Please can anyone suggest if there is any specific format for covering letter.
I won an appeal in First Tier tribunal which lasted about 13 months from the time of application rejection to the date I received residence permit. I dont have any proof/stamp for this 13 months other than it being mentioned in the letter of determination from the judge of first tier tribunal.
Sounds daft but do I need to provide supporting evidence for stay during appeal?
please suggest.

thanks in advance.

HI Everyone
I am a silent reader on this Thread. I had my PEO Appointment on last Friday 23-09-2016 regarding Long Residence 10 years Route. I am very happy to announced My ILR Application was Successful. Whole procedure Took place 3 hrs and 30 mins. My case was Pretty straight. I hired a Solicitor he did not do much apart of just submitting the Docs. So my suggestion to everyone do not hire any solicitor if you think your case is pretty straight u can take advise but never hire any for Premium Service. Coz at Home office they don,t do much. i spent £960 in which they prepared my case. Anyhow all done i am not worry about money. just letting you guys. Best of luck everyone .
