Moving to dependent visa from tier 2 general sponsored- impact on ILR

Post by Smash123 » Tue Jun 18, 2019 2:33 pm

Hi All
I moved to UK on 2016 dec in tier 2 general visa now after 2.5 yrs i am considering moving to a dependent visa of my spouse to have more flexibility in seeking new employment options.
I would like to understand how does this impact the ILR. Will the time spent in UK get reset and will the timeline refresh from this year on or will the 2.5yrs spent in UK will be taken into consideration.

Regards
Ashwini

Yes. You need 5 years as dependent spouse before you can apply for ILR based on 5 years residence. Presumably you are looking to move to Tier 2 Dependent visa as you don't state what your spouse's UK immigration status is??

No it won't, not for ILR based on 5 years residence.

Yes i will be moving to tier-2 general dependent visa.
So my understanding is that the clock resets and the 5 years counting will start again.

Correct yes. You cannot combine main PBS time and PBS Dependent time to make up 5 years, the rules don't allow this for ILR based on 5 years residence.
