You are required to invest the required amount in the business. Again I repeat, the UKVI may question you on this
Ok sir but my question is about loan from bank
Because of covid 19 the company had an impact on business so we took loan interest free for 1 year isit fine ? Has loan got anything to do with ho
No
Ok zimba so the loan has nothing to do with ho right
Because i came on venture company capital 50k investment in uk,but we haven't paid them back the 50k as of yet.. so me taking the loan from bank ,do i need to pay back to bank before i apply for the accelerated route IlR or even i don't pay bank back before application its fone

Your wife needs 5 years residence before she can apply for ilr. You cannot include dependents in your accelerated route ilr.

She can apply for ilr when she meets the requirements. Absence for dependents only counts for visas issued on or after 11th January 2018. So only absence on her current visa if granted recently are relevant.

You need 5 years residence which must include 1 year on ilr before you can apply for citizenship. Citizenship has separate absence limits and requirements.

10th March 2022 minus 28 days is the earliest she can apply.

Apply for accelerated route with 4 years

Post by Royal_desire » Thu Jan 07, 2021 9:14 am

Dear modz

Came to uk in march 2017 on tier 1 entrepreneur visa applied for extension in july 2020 visa extension approved octorber 4 2020

My query is i have created 10 jobs since octorber until
Today will i be eligible to apply for the accelerated route for ilr in octorber this year if the employees are
There for a continuous period of 12 month

And the 180 rules of absences only how do we count
In 2020 i was 60 days absenr
2019 126 days absent
2018 137 days absent
2017 350 days absent

So 2017 only had more absent but we only count three years before applying for accelerated route right ? Please telme advice me if i can apply for ilr accelerated route so i keep all my employees intact til octorber this year

You need 10 employees each who have worked for at least 12 months. You must have payroll submissions to support this

You must run a payroll, submit the payroll accordingly and pay the appropriate taxes/NI to HMRC. The way you pay the employees is irrelevant. The start date submitted to HMRC will be used to determine how long they worked. Did your accountant submit payroll for all those months ?? Do you know that you need to submit RTI submissions in the form of HM Revenue & Customs full payment summary (FPS) as evidence?

Only HO can answer whether they will have a problem - and they will only tell you that after they process your application.
But, in general, paying in cash in itself is not a violation of the immigration rules.
However, it appears you have not submitted their RTI from April to November. That also means you have probably not paid NI, PAYE and pension for those periods. Again, by itself none of this is violation of the immigration rules but it will likely make HO question the genuineness.
My comments are in no way meant to be advisory. I have no professional knowledge of immigration. These are based on my own experience, convictions and personal interpretation of publicly available information.

Paying in cash is perfectly fine. There is no requirement on how someone must be paid. It is only important that their pay was reported via RTI to HMRC and correct taxes were deducted and paid. How you paid them is irrelevant. If you submitted the payroll, then you should face no issues
