(i) the biometric data page of a British or EEA passport showing the photograph and personal details of the employee;
(iv) if the employee is an EEA national, a UK registration certificate/permanent residence document;
Both passport page as well as pre-settlement or settlement evidence

I suggest reading the guide. It is very clear what you need to send. You need to show that employees were settled when you hired them :!:

If you do not trust your solicitor's advice why are you paying him but come here for advice ?? I never understood this arrangement from applicants here. It seems you do not trust anyone's advice at all so what is the point of seeking it in the first place ?

Also, an expired passport does not mean an employer was an illegal worker. If my British passport expires do I stop being a citizen ?? That is nonsense. You are only required to check the right to work of an employee at the beginning of the employment and keep evidence of that. :!:

Yes the passport must be valid when you check it but that does NOT apply for British/Irish nationals. The official right to work guide disagrees with your solicitor regarding a British citizen
List A – acceptable documents to establish a continuous statutory excuse
1. A passport (current or expired) showing the holder, or a person named in the passport as the child of the holder, is a British citizen or a citizen of the UK and Colonies having the right of abode in the UK.
2. A passport or passport card (current or expired) showing that the holder is a national of the Republic of Ireland.

You should have asked for a current document however I do not see if that causes an issue in your case. Again the test is if he was settled or not. If he was an EEA citizen, then he was settled. Submit the expired copy
