SET(LR) question

Post by jilanivin » Wed Sep 11, 2019 10:24 am

Hi Sirs,

I have a similar concern.

An applicant’s(A) leave expired on 25/03/2013, on 24/03/2013 A has submitted an application under Tier 4 which was withdrawn on 29/10/2013 following a voluntary departure on 06/11/2013,

My friend had his Nikah in December.

They submitted an application for entry clearance on the 01/02/2014.
A re-entered to the UK on 01/03/2014

What I understood from the rules is that A's 3C Leave ended on 29/10/2013 and as A doesn't have valid leave as on the date of departure ( 06/11/2013 - i.e he overstyed for less than 28 days ) and has not submitted an application for Entry clearance within 28 days , A's continuous leave must be treated as broken though he reentered the UK within the allowed period of 6 months.

Can you please confirm my understanding please.

Please do not tag your questions onto other members topics as you were already asked in June when you did the same.
