ILR via SET(O) - application date

Post by amsin123 » Fri Sep 13, 2019 8:29 am

Hello,
I am applying for ILR via the set o route - my husband has settled via the Tier 2 route.
I have a tier 2 dependant visa. I am eligible to apply for ILR from 23rd Sept (5 year period ends on 21st October)
1. Is SET (O) the correct category?

2. I am planning to take the premium same day appointment .
I would ideally want to submit the online application now to secure an appointment for after 23rd Sept, but I am not sure what will be considered as the application date - date of online application or date of appointment.
Can you clarify please?
Thanks

What date was your initial dependent visa issued?
1. Is SET (O) the correct category?
Yes.
2. I am planning to take the premium same day appointment .
There is no longer a 'premium same day service'. The premium service centres were closed in November last year.
I would ideally want to submit the online application now to secure an appointment for after 23rd Sept, but I am not sure what will be considered as the application date - date of online application or date of appointment.
Date of application is the date you submit and pay online, which should be within 28 days of the 5th anniversary of the date your initial visa was issued. The date of appointment at UKCVAS Sopra Steria (third party for biometrics) is irrelevant.

Thank you CR001
My visa was granted on 21st October 2014.
Are you saying there is no way to get a quick decision anymore? What are the processing times for the visa then?
Thanks

I thought there was a super priority service which costs £800?
How do you opt for it?
Is it after you go to your appointment?

Premium service same day decision is NOT the same as the new Super Priority service. Premium same day service was an appointment with HO directly and seeing the caseworker at your appointment. Super priority is a decision (usually) within 24 hours, but it is not guaranteed and many members have waited a few weeks to hear. You do not see any HO staff at UKCVAS as they are a third party agent and not HO employees.

Once you apply and pay online, you will be directed to the UKCVAS Sopra Steria page to book your appointment. You choose the Super Priority or Standard service option before you pay for your Set(O).

Hello,
just one more question - once I get my ILR, can I apply for naturalisation straight away or do I need to wait for 12 months?

If your spouse is British, then yes you can if you meet the 3 years residence requirement to apply as a spouse of a British citizen.

If you spouse is not British, then you have to wait.

You need to meet the specific requirements of 3 years residence, i.e. absence limit and physically present at the start of the period etc to apply. You will need to check you meet the requirements.

Hello,

Just wanted to check the document list for the Set(o) application:
Application form
Declaration of consent for additional checks
The passport
Biometric card
Life in the UK test pass certificate
English Language requirement certificate
All previous passports
Is there any other document I am missing?

Also, there are 2 questions in the application:
Is the account with a bank or utility company for which you have supplied information and supporting documentation held jointly by you and other people?
Does the account with the bank or utility company for which you have supplied information and supporting documentation relate to another person who is to provide you financial support?
But I am not really supplying any bank statements. So how should I answer these questions.

Thanks in advance,

Regards

You also need 2 years cohabitation evidence in both names.

Another question about the consent form.
I understand I should sign Section 1.
Since I will be providing council tax bill for cohabitation proof, my husband should sign part 2.
I am assuming he doesnt need to sign Part 3 as I am not submitting any bank statements?

Set (o) consent form

Post by amsin123 » Tue Sep 24, 2019 8:26 am

Hello,
I am on a Tier 2 dependant visa and I am now eligible to apply for ILR.
My husband settled via the Tier 2 route and he is now a British citizen.
I am working myself and my husband doesn't support me financially.
Questions:
Should my husband sign Part 3 of consent form?

I am submitting these documents - is this enough?
Passports
BRP
English lang requirements
Life in UK pass certificate
Marriage certificate
council tax bills for last 5 years

I am not providing any bank statements or any proof of me working (*although I am working). Is this ok?

You sign part 1.
Husband signs part 2
leave part 3 blank

Is the account with a bank or utility company for which you have supplied information and supporting documentation held jointly by you and other people?

I would assume yes. Because you need cohab docs. Only council tax bills are not enough. You need 3/4 different sources covering last 2 year period every 3/4 months.
Gas/Water/Elec Bills
NHS letters
Bank statements
Tenancy agreement
Sky/Virgin contracts
etc

Thank you very much for your response.
Other than council tax bills, none of the others you have mentioned are in both names (bank statements, elec/gas bills, water bills, etc are all just in my husband's name)
Is that ok?

You need to prove that you have been living with your husband for the last 2 years.
Ideally a couple documents should be in joint names. If not, top in up with documents in solo names but same address. For example a UK driving license showing the same address but solo names. Your bank statement showing the same address. NHS letter in your name but same address etc.
You have to prove that for the last 2 years spread evenly i.e every 3/4 months.

Understood - thank you very much

Just saw this on the home office website:

"You must also have been living with your partner in the UK for at least:

2 years if you applied for your current visa before 9 July 2012
5 years if you applied for your current visa on or after 9 July 2012 "

My current visa was granted in September 2014 ( based on which I am applying for ILR)
Since my current visa was granted after July 2012, should I provide supporting cohabitation documents covering 5 years?
