Earliest date to apply for ILR

Hello!

My tier 2 visa is:

valid from: 26/04/2016
first arrival: 15/05/2016

Questions:

1. What is the earliest I can apply for ILR: is it 28 days before 26/04/2021 or 15/05/2021?
2. According to https://assets.publishing.service.gov.u ... 2.0ext.pdf
Any absences between the date of issue and entry to the UK count towards the 180 days allowable absence in the continuous 12-month period.
The time period between when my visa was issued and my first arrival is 19 days. I'm not worried about meeting 180 days requirement, as even with those 19 days, i didn't take even close to 180 days off in 2016.

But there are only 4 weeks of unpaid leave allowed. I had 2 weeks of unpaid leave after I'd started my employment (which was on 17 May 2016). Now I'm confused - will the time between visa issue date and my arrival also count as unpaid leave? Does this affect when I can apply?

Oh thank you. I was wrongly informed then by someone else that it is only arrival date and not the visa issue date that matters!

Can you please also reply to my question about the period between visa issue date and arrival date? Should I list it as absence in my application? Does it count towards the unpaid leave limit of 4 weeks?

Just getting through my application and have a few questions:

1. I plan to apply the earliest: 28 days before 5 years pass from my tier 2 visa issue date. What should I answer for "How long have you lived in the UK? "? Because that would mean 4 years and 10.5 months really. Is that ok to answer?

2. I'm using the online portal for my application and the link i've received says "Use this link to sign in to your application:

I'm not applying for a long residence route, I'm applying after 5 years on Tier 2. Any chance I'm filling in a wrong form? I was fairly certain I started the right application

Thanks, don't know how this happened. Just filled in the correct form and have a couple of questions:

1. Is 'annual leave' enough for a 'reason for this time spent outside the UK and Crown Dependencies'? Or do I need to add more details?

2. At the very beginning of my employment I took 2.5 weeks off to finish moving countries, that we agreed to be unpaid leave with my employer.

2a - Is 'finish moving countries' enough for a reason?
2b. - In the list of absences that my employer will sign, do I need to specify that was unpaid leave?

3. Sounds like a very simple question, but what should I specify as my annual salary? The most recent P60 i've got is from 2019 financial year, issued in April 2020. Since then I've got a slight pay rise, but I only have monthly payslips. Should I calculate annual salary from the most recent monthly payments? Both P60 and monthly * 12 numbers would meet the SOC requirements.

4. Do I need to submit tenancy agreement or utility bills to prove that I have accommodation in the UK? Suprised I didn't find this requirement, but I know many people ask questions about this?

5. If I don't have a joint bank account, I assume I only need to sign the Part 1 of the consent declaration?

6. Suprised to see that Priority and Super priority service options are available to choose from. Are they back for Tier 2 general >> ILR applications?? Or should I not hold my breath?

7. "Evidence of XXXX's immigration status in the UK" - is this different from BRP at all? Asking as BRP is listed separately.

Dear forum advisors, need help!

1. I get paid on the last working day of every month. In February it was the 26th February. I plan to submit my application on 30th March, so the most recent payslip would still be from 26th February - is it going to be accepted? Or is it going to be more than 'one calendar month earlier'??

I can of course wait for the 31 March payslip, but then I will have to have another 3 weeks as my bank statements are generated in the middle of every month :? :? :?

2. If I had unpaid leave of 3 weeks - what exactly I put in my employer's letter? Do I need to specify it was unpaid or will just saying it was 'annual leave' suffice?

1. Your most recent payslip and bank statement must not be older than 28 days. 26th Feb to 30th March is more than 28 days. You can also go INTO the bank for bank statements!!

2. Unpaid leave is NOT 'annual leave'.

1. I'm honestly a bit confused, will I provide the bank statement, payslips and letters from employers at my biometrics appoitnment or will I need to upload them after I pay for my application online?

In either case, can I pay on 30th March, book biometrics and then upload the payslip and letters within the next week? So the payslip date would be after the application date. Just really don't want to waste time waiting to book an appointment!

2. So would "Finish moving countries" be enough? Or should I say the reason "Unpaid leave - Finish moving countries"?

1. You upload them yourself. They just be dated within 28 days on or before the application date, which is the date you submit and pay online.

2. If the leave was before you loved to the UK and stated working for your employer,you do not need this stated in a letter.

1. Ok, so I figure I will have to wait for my March payslip before I can submit the applioation. Oh well!
2. It was after my 1st week of employment to finish some moving tasks (hence we agreed it would be unpaid)

Just back from the bank, they will issue an 'interim statement' whatever it is, but it is going to take a couple of days + bank holidays. Can I still submit the application and try to book biometrics appointment, which is likely to be in several weeks from today? I will then still upload the statement before biometrics... Or do I absolutely have to have the statement today to submit my application?? :? :?

Sorry, I felt so confident in those questions and now I panic. In the letter from the employer, the requirements say "confirmation that this is at or above the appropriate rate for the job as stated in the codes of practice for Tier 2 sponsors. (See note 8 below)"

1. I cannot simply find "codes of practice for Tier 2 sponsors" anymore
2. I found "Statement of Intent:Codes of Practice for skilled workers": https://assets.publishing.service.gov.u ... orkers.pdf which states for my SOC 2135: Experienced worker: £30,600
3. There is also a list of "going rates" at https://www.gov.uk/government/publicati ... tion-codes

where going rate for my SOC is £36,600.

My salary is higher than both, but my letter refres to "Statement of Intent:Codes of Practice for skilled workers". Is this ok?
