Good evening Everyone,

I have completed 5 years as a refugee and I have applied for SET(P) form will I be granted refugee ILR this means after 1 year I can apply for British citizenship? As I've been looking online and also heard from people that upon completing 10 year route as a refugee only then you are granted ILR?

(I was granted 5 year refugee status which I have now completed)

I'm confused and concerned any advise on this will be a huge help.

Can you tell if you had any valid visa at the time of asylum application.
If you were not illegal at the time of asylum application then you don't need to wait for 10 years &after 1 year of ILR can apply for citizenship. Even if somebody has overstayed a visa & then applied for asylum can apply for citizenship as overstaying period can be disregarded if there was no illegal work during the period.
Citizenship under Tory crooks has become a complex application where most applicants have no idea what would be the outcome.

Hi, thank you for your reply.

I overstayed for 2 years and 2 months after visa expired no illegal work/activity was done during this time. Nothing like this was mentioned that there will be another 5 year visa granted for people who overstayed and need to complete 10 year route.

I'm really confused and concerned.

Hi I had five years refugee visa granted after I applied set p ilr application and got ilr refugee status. So who has five year granted as refugee they will get ilr but it’s very tricky as mentioned in previous messages

I’m also confused about apply for British passport as before I applied asylum I have a issue with toeic test and my visa was curtailed after I applied asylum . Now I book Uk life test and I read as well 10 years good character on Uk visa site.

During interviews I cleared about my English language and I admitted that I was paid for toeic and gave all evidence when and what I had bad circumstances and when I did this offence and home office realised my condition as I was became victim of domestic violence and under treatment and case was in court so I don’t know can I apply for citizenship now and should be waiting for complete 10 years?
Anyone might be any suggestions?

I think you will get ilr but can’t able to apply British citizenship as you require 10 years for good character as you lived over stayed.

I have recently approved my ilr application as I haven’t my home country passport I lost during travelling so I have taken my travel document with resident card brp with me during my appointment and just he scanned my travel document as I uploaded my brp card already so you don’t worry about passport if you don’t have .

Hi everyone .
I applied my refugee settlement after 5 years and I am still waiting for my decision as my 2 friends also applied on the same time but they granted the ILR but i am still waiting . it’s almost 50 days now after the appointment.
Anyone know how long they are taking time for replying .

TIME LINE for Refugee settlement after 5 years .
APPLIED ONLINE 15/10/2020.
APPOINTMENT 12/11/2020.
Still waiting for replying .
Very stress full time now .

Can you please advise what supporting documents have u submitted with the application, as they only requested the Travel document and Residency card.
Also if you have applied yourself or through a lawyer ?
Did you experience anything to do the right to work after submitting your application and if yes is the acknowledgment email after submitting the application is sufficient or would you need a letter from a lawyer. Sorry for all these questions your answer will be very much appreciated. Thank you

If you have accepted to the home office that you have cheated them on English test then it will be difficult for you to get nationality before 10 years legal stay. But nothing can stop you applying & if refused going to Judicial Review .But as the system doesn't provide justice hence nobody knows how the high courts even don't care the way this discriminatory rule so called Good character requirement is applied.
There are about 45% of migrants holding ILR but this discriminatory rule has blocked them gaining citizenship. There is no justice whether you ask for discretion or seek JR.

I have been a silent observer of this page for over 2 years.Thought of sharing my timeline with everyone.

Applied for Set p on 14-12-2020
Biometric done 06-01-2021
Approval email 13-01-2021

It took under a month for HO to approve my ilr. Very straightforward application, so i would say apply it yourself rather than paying a solicitor.

Also No dependent, It was a solo application!

Hi Beloo,

The only acknowledge from the HO you get is an automated email saying that the application has been submitted. You get this email as soon as you press the "SUBMIT" button on your application form.

Regarding the right to work, you can check this here https://www.gov.uk/prove-right-to-work and also generate a code to share with your potential employer to prove that you are eligible to work.

For Sopra Steria, if you had subscribed to the SMS service then they text you informing that the documents have been submitted to the HO. If you are unsure, you can always call UKVCAS on 0844 8920232 and check with them whether your documents have been submitted or not. Please note that they will not be able to provide you with any update on your application and calls to them are charged at £0.04 per minute, plus your provider’s access charge.

In my personal experience with Sopra Steria, I got a text message later on the day of submission of my biometrics confirming that the documents have been submitted to HO but I had paid for the SMS service. Just to check I logged on to UKVCAS (Sopra Steria) site and I can still see my application details on when it is booked for etc. However, I do not see an option to book another appointment.

Hope this is helpful and hoping that someone else can also share their experience regarding this.

Thank you for your reply, I’ve got the Application Submission confirmation email from HO also the SMS from Spora-Steria, so I should not expect any communication from HO until the decision is made? Also when I log in to my application is it going to be showing the same thing again until the decision is made?
The link for the right to work showing that I can work until the expiry date of my current leave what is showing after that date for people went through this before? I mean after that date the decision won’t be made yet so is going to show that I don’t have the right to work?

Hi Beloo,

That's correct, the only correspondence/communication you will get from the HO will be regarding your application. They will contact you in either of the three circumstances 1) to inform you of the outcome of your application, 2) inform you if there are any delays and 3) ask you to provide any additional documentation.

I have already got a decision for my application and I logged on to Sopra Steria, I can still see my documents submitted and same with my application form. These are I think usually available for 180 days after the application has been submitted, however, I am not entirely sure about that.

You can continue to work until the decision on your application has been made unless you have been asked otherwise by the HO.

The forum is to help each other and share our experiences. This is a process that we have either all gone through or still going through and everyone has got the unique experience of their dealings with the HO. These forums make is very useful to get all of the information at one place and also help draw on each other's experiences.

Hello everybody, I had been reading this forum for about 3 years, trying to get a good knowledge of everybody experience´s to get ready for my application.

I did my application last November and today I got the reply from HO with a positive answer :D
I want to say thank you to everybody that takes time for posting and share their experience I give us hope

BRP expired: 21/12/2020
Apply Online: 19/11/2020
Appointment for Documents and finger prints: 12/12/2020
APPROVAL EMAIL 12/02/2021

For anyone wondering what document were need it:

-copy old national passport ( HO sent them to me after the application for asylum was done 5 years ago)
-copy of council tax ( for profs of residence and not being away from the Uk in the past 5 years)
-birth certificate ( for a child born here in the UK)
-BRP
-also I cover letter from my solicitor explaining why they believe my case was favourable for being successful

Note: if you don't have the money to pay a solicitor you can get help through an AID found but you need to have Universal credit or any benefit, I did pay for mine but a friend of my got some help with hi's but guys the application is really easy to fill you won't need a solicitor is a waste of money I was charge £1200 for me and family. I recommend getting a solicitor if you think you really need it. ( if you have any criminal offences or something like that)

I was just about to write a letter today but received letter from HO, saying they aim to process all applications within 6 months but my application has caused some complexity and that they'll process it within 3 more months. (new date given 01 Feb 2020)
So... God willing I shall now wait another 3 months.

So, nothing received at all. No correspondence. The revised date of 1 Feb2020 had been long past. It's very frustrating to be honest.

Finally received my BRP today! Thank GOD! It was a long 14+ months journey. I know how it all feels but just stay positive and have trust in God :)

Thanks, (sorry I might be a bit too late in replying). It was couple of letters via my local MP to HO throughout the 14 month window, first after 8 months, second after 12 months.

In general of course a refugee cant travel home country .There is no diffenrence between a refugee leave &refugee ILR when it comes to revocation as they see the reason for revocation &status in both leaves is the same which is refugee.

Hello Showpower
After having ILR for 1 year you can apply for citizenship .If you tell them that you haven't been working during overstay & ask for discretion .If you provide proof who was supporting you during overstay period e.g family or friends with documents like bank statements & if not possible then supporting letters from them stating they have supported you ,this would stop HO thinking you have been working illegally hence you get more chances of discretion being applied in your favour.
Just overstaying isn't enough ground for HO to refuse citizenship & it can be challenged if refused as HO guidance clearly states if overstay is the only adverse factor in someone's good character then it can be disregarded.
Good luck ,I think if you can provide above mentioned you would be successful provided if your caseworker is a nice person. A nice caseworker doesn't mean they don't refuse applications they do but being fair & being fair with you is the grant of citizenship.Another thing it is rare to have nice caseworkers.

Hi everyone. I am going to apply for ILR on Set (P)online form. I don't have any penalty points on my Driving licence. I have totally 5 ticket (1 parking ticket and 4 bus lane ticket) but I paid them on time nothing outstanding. Should I have to disclose them?
