Spouse visa ILR application need help

I live in the UK since 07-Feb-2014 and hold a Spouse/Partner leave to remain resident permit, which is valid until 11-Jan-2019.

My initial Spouse Visa was valid from 18-Dec-2013 and my first date of entry into the UK was on 07-Feb-2014 which is 51 days from visa validity. I submitted the application for Settlement on 26th Nov 2018 and had the UKVCAS appointment on 22nd Dec 18. I had applied for the super priority service. Today (24th Dec 18) I got an email from UKVI saying ‘Your application for indefinite leave to remain has been assessed and we will send a response once you have been residing in the United Kingdom for 60 months.’

I am not clear what this means. Please help

You applied too early for ILR. You should only have applied within 28 days before 7th February 2019 and the earliest date would have been 10th January 2019.

Your residence clock for ILR starts from the date you ENTERED the UK and not the date your visa was issued.

The message appears to mean HO will hold onto your application until such time as you meet the 5 years residence requirement for ILR.

Thank you very much for your quick reply. So would my application made on 26th Nov (Set M) would still be valid. I am confused what I should do next. Hope UKVI has not refused my application

All you can do now is wait for HO to contact you as their message says.

You did not qualify to apply for ILR on 26th November, so hopefully they will re-consider it once you reach 60 months rather than simply refuse it.

Sorry to bother, but one more question. I currently work in UK and if I get my ILR only by 07 Feb 2019 what would I do as my current bio metric is valid only until 11 Jan 19

Your existing visa conditions continue after your current visa expires under Section 3C of the immigration rules. You won't be an overstayer and can continue to work, so don't stress.
