I had a Drink Driving offence from 2011 which I had informed in all applications since then. Although its considered 'spent' under Rehabilitation Act (been 5 years since the ban), I reported this in the ILR application.

I wasn't sure if I had made all my previous applications within the period of my visa (before end date) so I made a Fast Track Subject Access Request which provided me all the details of previous applications and when they were submitted, this was helpful. Appointment was at 9.00. Formalities were done by 10. My application went to consideration status at 11:30 (apparently there was a delay in getting my biometric information from other agencies - probably because of the driving ban) and was approved at 12:15.

Hi,
I have a question. I came in the UK 10 years ago on a student visa. I completed my degree in 2011 and got PSW on 07/06/2011 till 07/06/2013. Then I applied for Tier 1 Entrepreneur visa which was refused on 05/07/2013. I went for appeal which was refused on 12/10/2013. Then upper tribunal and the last right to appeal were exhausted by 26/11/2013. At that stage, my solicitor advised me to go for JR. I went for JR but got refused on 07/02/2014. Then I was advised to go for student visa which I applied on 02/03/2014. On 26/02/2015, I received a curtailment letter from HO in which I was asked to get a new CAS as the previous college was closed down. I paid heavy fee to the college and got the CAS. Then I sent the docs on 28/04/2015. HO refused my case on 05/05/2015 stating that as I was overstayer since 26/11/2013, I did not have the permission to make an application. I made another JR in which my lawyer explained that when I was overstayer according to HO, why did they not tell me when I sent my Tier 4 application in 2014? But the permission to hearing was refused on 03/12/2015. As it was not physically possible for us to go back, on 23/02/2016, my spouse claimed asylum on Political grounds. Since then, we are waiting for decision on our asylum case. During my period in the UK, we have three kids: 6 years old daughter, 5 years old son and an 1 year old daughter all born in the UK.

My question is what are the chances if I make a long residency application now explaining the situation that I was misguided by a lawyer to go for JR. I took the advice of a man of law who proved to be wrong. And I am a highly qualified and law abiding person who has never done anything wrong in life. There is a threat to our lives that's why we claimed asylum.

Kindly, advise me in this regard if it is wise to submit ILR application at this time. I understand there are minimal chances of success.

Hi,
I advised you to take firs time early appointment that is about 8 o'clock. You don't need to take your business related documents with you.
May I ask when is your visa expiring?
Is business related to your professional degree?(mine was)
Have you invested the full amount or just partially?

By Grace of God, my ILR application based on Tier 2 was approved recently at Glasgow PEO.
I am grateful to all members who are active on this forum for sharing their own stories, special thanks to all the moderators for their advice and guidance.

Details as below:

2. Number of dependents: 0

4. PSC branch: Glasgow
5. Documents provided:
• SET O
• 2 Photographs
• Passports & BRP
• Employer letter (from current employer)
• Absence letter from employers (current and previous) (only 47 days in 5 years)
• Life in the UK test certificate
• English Language B1 certificate from Trinity College London
• Last 3 months pay slips
• Last 3 months bank statement
• HMRC employment history letter

Any Additional Comments:

I submitted two separate folders with plastic sleeves -
1) Originals + SET O
2) Photocopies

No questions asked, the whole process was smooth and overall it took just around 2 hours.

I am happy to answer any questions that you may have.

I advise you to try to change it to early as possible
And in the form "what ties you with the country " don't mention your business just provide all your passports, degree,photos and life in the UK certificate nothing else, there is no such form officially in this category.
Be confident believe me they have access to hmrc records, if you give them access of paperwork they further try to dig things up. Keep it simple as possible.

No Faysal I didn't send early ILR application. Instead, I first sent an FLR(FP) application and now that I've reached the qualifying period I have booked a premium service appointment. Will be varying my application. Although an early ILR application is also possible and quite a few people on this forum have successfully got their ILR, I didn't choose it as FLR and later varying to ILR is a safer route as you're covered by 3c.

Our appointment was at 9.10am, we reached office by 8.30pm and given a token number. We have waited 20 mins to get our number called. Our Number called around 9.15am, we have gone to designated token counter and submitted all the documents. After that in the next 10 mins our token number called for BRP. With in 5 mins BRP was done. Then we left to the coffee shop area and waited for 90 mins. Roughly around 11.10am they called our number to a different booth. Once we reached, the officer told us that the application is approved and we will receive the BRP card in 4-10 working days.

We have received the BRP card after one working.

I have submitted the same docs but they ask me for CT600 (2013-2014) as I am self-employed and still waiting for my case to be decided.

No what they gave a form if you are self employed. Then there is a long questionnaire to answer.

I put only ties I have at back home i.e parents and sisters that's it.
If your immigration history is straight forward and you already doing your business, it should be fine because you are not in breach of immigration laws as you mentioned you Already have invested 50k. Just make sure your company records are straight i.e No pending returns or accounts if its a limited company.
If you put business as a tie you have in UK then you have to provide documentary evidence, further they may dig into history of tax returns and nature of business, this opens a door for many many questions that probably you have no Idea how they interpret your answers.
So my advise to you is, keep it simple as possible. Just in case they ask you to provide further documents, ask them to give you some time to produce documents. Consult with a good lawyer before posting further requested documents.
My immigration history was straight forward, entered as a student then MSc then PSW then Tier1 ent 200k, set up limited company in same profession,invested partially. Never refused visa, never overstayed all I had to do filled application form provide all passports,BRP, degree and life in the UK test certificate. At backend I checked with HMRC my tax returns and corporation tax are up to date. Didn't take any other documents with me as they were not necessary. Think smart like a professional UK resident and avoid to have unnecessary words or documents with you if you will be asked questions just answer short and to the point with 100% confidence. Be positive you have contributed positively to the society during this long period this itself a strong evidence of your conduct and ties with the country. Hello Friends,

I need advise on my ILR application, i am looking to book PEO appointment however i am not sure

1) If i have to submit SET (O) form as which option do i tick for payment, as it doesn't have PEO fees / payment option

This is the form, i am referring to

2) Do i have to submit P60's (is it mandatory)?

3) Is there a format/template of the letter that company has to provide confirming my Annual Leaves for last 5 years (i.e. out of country)?

6) I am looking to submit the following are they okay or do i need to have further documents?

Good to hear that,

Just to confirm, i believe you were already on ILR and you do not have to apply for your family at the same time and they can continue to stay on the Tier 2 Dependent visa even if you have ILR?

Also, was there a reason for you requesting ILR for your son and not applying directly citizenship for him?

Yes, I believe my dependants could have continued based on their Tier 2 visa as that is valid for another few months.
My son is not born in UK so had to take his ILR too.

Hi Martin

Many congratulations on ILR approval.

I have a similar situation as yours in which I got my first Tier 1 (General) extension done in combination of UK PAYE and Overseas PAYE.

Appreciate if you can suggest the documentation we need to submit specifically for the overseas income and is there any Tax related document we need to submit for Overseas Income ?

Hello all,


Thanks to Almighty ALLAH . My application for LR has been successful at PSC SHEFFIELD.

I was on Tier 1 HS Entrepreneur visa for almost 2.5 years and applied for ILR which was granted within one hour into appointment time.No business documents either submitted with application or asked to be shown by case worker.

Business documents I took with me includes 3x months business bank statements, SA 302 & confirmation of statement but never included in the application.

Keep your application simple and don't put additional burden of documents in it.Only show it if being asked.


I will suggest everyone to try and book early morning appointments as you will be seen very quick.
