i assume below would be possible outcomes if you put forward request for cancellation or withdrawal of your application..
1. You may lose your permission to stay in the UK . or they will give you a date to leave UK.
2. you wont get fee refunded for sure.
3.You can’t stop the cancellation once your request is received by Home Office.
4. if there is a possibility to get your documents without canceling .. you will be told this when you fill up cancellation /withdrawal request form.

1. main applicant
2.Tier 1 point based System
The main applicant:
is a non-EEA national
has applied for limited leave or to extend their leave under Tier 1 of the points-based system
has used a Tier 1 form or applied online

3. want to withdraw the application

then

Withdrawing your application will also withdraw any applications for dependents linked to your application. All documents submitted will be returned to you. The application fee will not be returned. If your leave has expired while you were awaiting a decision, you will become an overstayer on the date the
application is withdrawn and any subsequent in country application that you make will be out of time.

i am not sure if it fits your description but i just gave you an example.

I have one more question:

I first came to the UK on 28th September 2010 and I will be completing 10 years in the UK on 28th September 2020.

I want to know if after withdrawing my current application, I go back to my home country and apply for Tier2 visa to come back to the UK within 180 days, will I still be able to apply ILR in September 2020 based on 10 year route?

Hi All,

Just an update from my side. Since my ILR application was taking long time, I managed to VARY my T1E ILR application to Tier2 visa by one of the UK employer.

To vary my T1E ILR application, the sponsoring employer had submitted my Tier 2 application online on 08th August 2019.
Also, I attended the biometric appointment on 12th August 2019 and the visa was approved on 13th August 2019.
Finally, I received the BRP with the start date as 17th August 2019


My question here is about the Fees refund which I paid initially for T1E ILR.
I have finished more than 1 month and still haven't received the refund for my T1E ILR application which was varied.

Could anyone please share some information as to what should I do in order to request for the refund?

You are eligible to have the fees refunded and they will be - what is not in your control is when it happens.

I recently switched from Tier 1 Entrepreneur visa to Tier 2 sponsored visa.
My time spent on T1E is from 05th November 2013 until 16th August 2019 (5 years , 9 months).
And, now I have spent over 1 month on Tier 2 visa and I have got my 1st pay slip under Tier 2 visa.
Also, I have initiated the process to close down my own registered company which I had during the time of T1E visa.

I have 2 questions based on my situation:
1) My first question is, when can I apply for ILR based on the time spent on T1 and T2 (T1 + T2 = 5 years 10 months so far)?
2) Also, the Companies House process to close (strike-off) the company takes nearly 2 months time. Should I wait for the company to get completely closed? Or can I still apply for ILR while the strike-off process is in progress?

I don’t think you can make use of the company you are closing down to get point to qualify for ILR. You have obviously decided to start a new journey by that action and you will need five years on Tier 2 visa to qualify for ILR. The reason is that there are so many requirements of Tier 1 that is needed to qualify you for ILR, for example business must be operating at the time of application, and evidence you intend to continue with business upon grant of leave. Secondly, there will be no information to relate with upon closure of business, so I assume you have started a new five years journey and at that time you will eligible to also use LR route after spending 10 years.

Why do you believe the op needs to wait 5 years on tier 2 before they can apply for ILR?

The immigration rules clearly state that tier 1 Entrepreneur and tier 2 General can be combined to make 5 years.

Tier 2 does not permit the OP to own and be a director of a company or received salary form a company other than the tier 2 sponsor.

Are you sure he would have been deemed to fulfil Tier 1 requirement after company closure. The rule simply states that there must be evidence the applicant intend to continue in business. How does he prove that having taken up a job.

He will be applying for ilr based on tier 2 requirement.

Ok I think I understand what you mean. Combination of both periods under Tier 1 and Tier 2 routes also because he is legally allowed to switch if need be. Ok

I am trying to find if Sopra Steria has suspended all Priority & Super Priority Service?

My employer is applying my ILR application based on Tier2 visa (I switched from Tier1 to Tier2 visa 8 months ago) after having completed 5+ years stay (T1 + T2)

Also, my employer told me that they will be applying my ILR application by using the Sopra Steria standard service which could take up to six months (not guaranteed) before a decision is made.
I am just wondering if I should push my employer to go for the Priority service but before I that I want to know if anyone on this forum is still able to see/book/use the Priority or Super Priority service?

Only some Centres are open and priority is being given to those who had appointment cancelled, who applied before lockdown.
