Dear guys
i will be joining an existing business that has 4 full time employees. 1,2,3,4.
if i join the business and create post 5 and 6.
if after 2 months employee 1 and 2 leave, will i need to fill their gap? or just protect job 5 and 6 to be elegible for ILR?

Yes. You must increase the net positions by two. So if 1 and 2 leave, you did not increase the net positions by two.

Yes but the 12 months does not need to be continuous. So 1 and 2 may leave but you must replace them. So technically 6 positions must exist for 12 months over the period you are claiming points for.

how do home office calculate net increase?
is it on the day i join the business? so just for argument sake if employee 1 and 2 leave this month and i join and then rejoin after i join the business will they count in my favour?

From the day you join a business as a director. The rules require you to send evidence of all positions/employees for a whole YEAR before you joined the business. They will look to see if you genuinely increased the net positions by two or not

thanks for your clarification. i have checked today and they have 4 full time employees. i will bring in 2 UK citizens.
are the nationalities, passport of employees 1,2,3,4 relevant to my job creation?
if employee 1 leaves does the replacement need to be EU or UK citizen?

They need to be settled in the UK. So they could be British, EEA citizens or people with ILR.

yes but his existing employees arent all EEA UK nor Settled.
the ones im bring are UK citizens.

hi Zimba
i have received payroll for the past 12 months.
the business is wedding hall/ event hall that includes catering. They are busy most of the time howver not all the time. Therefore for the past year they would have 3-5 employees.
how can i add my job creation to the business?

hello everyone
1- do i need to be a shareholder in the company that i am joining?
2 do i just need to be one of the directors only?
3- i was offered a directors role in a company with a good turnover, however the other director works from home and does not have a business premesis? will that be acceptable?
