Tier 2 General and receiving child benefit

Post by ddso84 » Sat Jul 18, 2020 4:04 pm

Dear Senior members.

Currently, I'm under Tier 2 General visa and my daughter have born in the UK (3yo).

Back there, when we applied for the child benefit, in the application page says that all children born in the UK are entitled to receive child benefit if you are resident. However, recently I realized that on my BRP card, it says 'no public funds'.

What should I do? Should I contact HMRC and cancel the benefit? Or I can simply not mention the benefit in my ILR application?

What you would suggest?

Thanks in advance
Danilo

What should I do?
Cancel it immediately. You are in breach of your visa conditions claiming benefits.
Should I contact HMRC and cancel the benefit?
Yes, and pay it all back too.
Or I can simply not mention the benefit in my ILR application?
That would be deception as HO will see on the system checks that you are claiming benefits.

Many thanks for quick advise, just got in contact with HMRC asking them to review the benefit.

My application due in a few months, do you believe I still have time to clean this up?

How it works?

Best regards
Danilo

Don't ask them to "review" it. You need to tell them to cancel it immediately and tell you how much the total claimed is that you have to pay back.

If what you have received from day one and it is all paid back, there should be no issues. However don't expect HMRC to work to your tight timeframe.

Thanks
