Tier 2 to ILR

Hi Experts,

I moved to the UK on 23/07/2016 on Tier 2 General Visa (granted on 16/07/2016) and planning to apply for ILR in the coming week.
The visa expiry date on my BRP is 15/07/2021 and as I understand I am eligible to submit my application only from 28 days to completion of my 5 years in the UK. As my date of entry in the UK is later than when the visa was granted, which date should I consider for calculating the 28 days period?

The date of entry is irrelevant in your case. Use visa issue date. Visa issue date + 5 years - 28 days

I have one more query regarding my ILR application. I have a 3 year old child who is born in the U.K. she is currently on dependent visa valid till July 2022 (My visa expires in July 2021. When I had changed jobs, my current sponsor had renewed my visa only uptill completion of my 5 years in the U.K. as they knew I will be applying for ILR but my wife and my child have dependent visas valid till July 2022 as my previous employer had renewed our visas for 3 years in 2019). My query is that do I need to apply my daughters ILR or I can directly apply for her British citizenship after I receive my ILR?

Hi,

Thank you so much for the guidance so far. I have now applied for the ILR and have a query regarding booking an appointment date for Biometrics. The earliest appointment available is on 17th July which is after my visa expiry date of 15th July. Will this mean that I am overstaying on my current Leave to remain and will this impact my ILR decision?

Hi,

Could you please share whether you have applied for ILR based on BRP card issue date (Issue date on BRP).
That is, 28 days before the "Date and Place of Issue" on BRP. Is that right??

Thanks for your response.
May I clarify if the issue date on your BRP card is the same as the vignette stamp on passport.
I am confused which date to consider for ILR application:
1. Issue date on my first BRP card (05-Aug-16)
2. Vignette Stamp FROM Date (19-Aug-16)
3. Date of entry in UK (23-Aug-16)
Based on that, I can then apply for ILR on (that date -28) days

Appreciate if you could share your experience please (If I understand you right, you have applied on the vignette stamp FROM date. Correct? ).

Hi,

I have recently received my ILR BRP card and want to check if this changes the BRP status of my daughter. She is born in the UK and her Tier 2 dependent BRP is valid till July 2022. With my status changing from Tier 2 general to settled, does her BRP still remain valid? We are planning to travel out of the UK and will be applying for her British passport on return but thought I should first check if her current BRP is valid anymore or not. I tried searching online for a government website to check the BRP status but couldn't find anything.

Please advise.
