Two months short for ILR

Hi,
Please suggest.
I am tier 2 general dependent. My visa is going to expire next week. My spouse got ILR already.
My ILR is due in March 2021.

1) Please let me know the procedure and guidelines from applying Tier-2 general dependent to ILR

2) Please can i know about the vary application?

3) Is it possible to apply for the vary application of ILR before eligibility and give the biometrics after getting the eligibility for ILR?

My history.
28th March 2016 -- First landed in UK and on first visa stamping
19th December 2020 -- Current Tier 2 dependent visa expiry

Assuming your spouse got ILR via PBS route.

What is your initial visa issue date?

My initial visa issue date on my passport is valid from 28 MAR 2016 but in my first BRP it is mentioned as 14th Mar 2016. I came to UK for the first time on 28th Mar 2016.

My spouse got ILR via Tier 2 general 5 years route

In this case take date of entry as reference point. And read the previous link for the procedure you may follow. You MUST apply for a Tier 2 dep extension before 19th Dec and proceed accordingly for variation as stated in the above link.

You need to read the previous topic first and understand the logic. Come back with the calculations, ill check then.

sorry I just have 2 more doubt regarding IHS of Tier 2 dependent.

1) For how many years should I pay for IHS for Tier 2 dependent?

2) In the work start date and end date, should I give my spouse Tier 2 general BRP dates or ILR dates?

Please suggest.

3 years.

You will have to see with the dates. Sometimes the system does not generate the correct amount.

My suggestion:

Apply Tier 2 Dep extension: 18th Dec (MUST before current expiry)
You get 45 working days to submit biometrics (you MUST submit biometrics to make the application valid)
Deadline for biometrics: 19th Feb (check calculations).

Submit biometrics for Tier 2 dep extension on: 17th Feb

Vary to ILR on 18th Feb (although your wife qualifies on 29th Feb only but as long a decision is made when she actually qualifies - CW must take date of decision to count continuous residence) - SET(O) form will ask if you have any pending application, mention extension application there, also add a cover letter for variation.

Submit biometrics for ILR AFTER 29th Feb (when she actually qualifies) and before deadline (45 working days from ILR variation date i.e 18th Feb).

Suggestions:
Note: Do not self submit any documents for Tier 2 dep, do it at the appointment only.
Note: Book an evening appointment for 17th Feb and VARY to ILR 18th Feb after midnight 12AM GMT.

**The detail guidance can be found in the previous user’s post.

** Your extension fee and IHS will be refunded in due course after variation is successful.

** Check all calculations yourself.

** Your wife will need to pass LIUK and B1 selt for ILR.

** Play with the above dates but the above is my suggestion.

A) You have mentioned "Do not self submit any documents for Tier 2 dep, do it at the appointment only."
so did you mean by booking "enhanced service" for the biometric of Tier 2 dep extension?

B) Medical Treatment (We have visited to GP several times)
1) Have you ever been given medical treatment in the UK? YES/NO
2) Were you told that you had to pay the hospital, clinic or doctor's surgery for your medical treatment? YES/NO
3) Where did you go for your previous medical treatment in the UK? A&E OR To a doctor,clinic or hospital for non emergency treatment
4) Name of hospital, clinic or doctors's surgery Address
5) When did you start receiving this medical treatment?
6) When did you stop receiving this medical treatment?

NO. I meant there is a new feature where you can SELF submit documents now via UKVCAS portal even BEFORE biometrics appointment. Your documents are sent to UKVI directly then. I suggest not to do that, rather submit on appointment day only - so no PRE case work can start (if any).

To be honest these are NEW questions added to the updated online form on 1st Dec. Not sure why. This is a generic form dealing with many scenarios. Just answer as you deem fit. It will not impact your case.

You can upload 1-2 days before EXTENSION biometrics appointment and submit at appointment itself.

Obviously you will be varying the application then. You can always self-submit the documents for ILR application even before biometrics appointment.
