Indian Citizenship and OCI

Post by kiranprasad » Thu Oct 05, 2023 3:31 pm

Hi Guys,

Today I went to VFS for submission of OCI.

Now they are asking me renunciation certificate along with Indian passport surrender certificate.

Actually I applied and received passport surrender certificate two months ago. so i don't know this rule.

But as per discussion with the my friend at VFS

"If you received renunciation certificate that means lost of Indian citizenship. if you want to gain it back then you need to stay for 10 years to get the Indian passport back even if we are OCI holder. I have seen the rule is that if you are OCI holder then staying 1 year out of last 5 years duration."
he suggested me travel with eVisa whenever required. so i can get back Indian passport quickly need not stay longer time as like in OCI holder. Is it true?

Could you please suggest me which choice is better?

Sorry to be blunt, it's not true.

Can you explain what you are trying to do? Are you trying to regain your Indian citizenship? Regardless of 1 year (which is not true) or 10 year residency in India, to apply for Indian citizenship, you will have to prove that you have or will renounce your British Citizenship. Are you prepared to do that?

Best thing is to apply for OCI and avail benefits it provides. In any case, your stay in India on eVisa will not count as that is not a residency visa - just like tourist visa does not count here for ILR purposes.
