Where the invalidation procedure was applied, the application was invalidated if it did not comply with the prescribed requirements within 28 days of the applicant or immigration adviser receiving notification. If the application was returned within that 28-day period but still did not comply with requirements, no further attempt to secure compliance should have been made. Regulations did not allow the application to be invalidated before the 28 day period expired.
In non-compliance cases, the application was rejected as invalid and a refund triggered. To allow for internal delays, the application was held for 35 days before rejection was initiated.
Last year when I applied for PSW, for some reasons my application was returned saying it's invalid and rejected, I think was due to out of date form (they only updated a few days before I sent..), or the photograph guideline not met,
maybe both reasons, maybe just one of the reason.. and they did refund the fee by cheque.
then I immediately updated the form and photograph and resend my application. after a few months I got the PSW no problem.
But question is that they did refund fee, does it mean it's actually worse for me? does it mean that the continuity is broken for the 10 years long residence?
