6 weeks rule - travel to UK - how to count -NON-EU

Post by juzmoraes » Fri Dec 07, 2018 7:58 am

Hi Guys,

I looked the forum about the 6 weeks rule that a person can be outside Ireland. But I could not find for this specific point. So..

I do a lot of work travel to UK, sometimes I fly in and out on the same day. So, I leave Dublin 06 am and back 7 pm (for example), but the passport only gets stamp on my way back to Ireland as we don't have passport control from Ireland to UK.

Does anyone know how do they account for this days in UK?

Thank you

Hi,

Count as one day and submit the summary of all trips explaining that you travel to work to the UK with no stamp out, only in. Should be fine. I have few like this, sometimes exit stamp only, sometimes only one in Dublin on the way back.

to be honest would be almost impossible to get a summary of all my trips to Uk in the last 5 years :(

I saw on this forum someone saying that the departure and arrival day doesn't count. But I guess no one knows for sure :(

I believe that they count only whole day absences so if you travel for a 1 day trip, u dont need to count.

I wouldn't count a day trip but that's my own opinion.

Get in touch with INIS, they should be able to confirm that point for you.

There isn't a clear definition as to how they calculate a day, so checking with INIS (preferably in writing) is the best way.

Using the Irish tax system of residence, before 2009, a day is counted if you are in Ireland in midnight of that day; since 2009, a day is counted only if you are present for the whole 24 hours.

Hi Guys,

I got clarification about the 6 week rule from INIS ....

Dear XXX,

I refer to your e-mail below.

The date of departure and the date of arrival are not counted as days
absent from the country.
