Hi
I came to Ireland last year January with a short stay visit visa and I got pregnant that same month, right now am confused on what to do because I and my baby’s father are no longer together, My child has an Irish passport. I wanted to apply for stamp 4 but he said he will not sign or help me process anything, he will only provide for his child, I’ve been worried, I don’t know the process of documentation in this country and I cannot go back home because of the crisis and killings back home and my baby won’t be safe. I met a friend who said I should seek asylum since I have a strong case. I really don’t know what to do and I cannot force my Ex to sign any document for me to be able to process my stamp 4. I’d really appreciate if anyone have an opinion on the steps I should take.

1) you have no claim to asylum as you didn't claim it on arrival and you can't do so now
2) you need a specialist lawyer. You are illegally living in the State and breaking any number of laws and immigration rules.
You can claim residency on grounds of your Irish born/Irish citizen child but it will be a long and difficult process.

Thanks a lot for your response.
I want to apply for my stay through my Irish born child but my baby’s father said he will not sign or contribute on anything that have to with me. So I shouldn’t get his name on any documents because he won’t give anything that is required from him for me, except it has to do with his baby.

Also I want to apply for asylum because I honestly didn’t come to ireland with the intent to stay, but I got pregnant that same month. Also I can’t go back home because my dad was killed because he converted to a Christian and my mum took us and ran away for safety reasons. Now they have disown our family and if I go back with my child we both may get killed.

Is there a way that I can apply through my Irish born child without my baby’s father getting involved? Or can I apply for asylum base on the fact that my child and I are not safe if I go home.

There are no hard and fast rules about applying for asylum,you can apply for asylum and also include every other human rights reasons in your asylum claim that should include having an Irish child. Also try and get documentations that will prove that your child is Irish. Also try and get a legal aid lawyer so they can advice you further.

Hi,

You should apply stamp4 as soon as possible If child is living with you and he has Irish passport.

You do not need father's signature if you dont live together.

You only need child birth cert, copy of child irish passport and proof that you are primary carer of your child.

This application will take 5-8 months.
