I am really really confused about card replacement. I am Uk citizen and my family stamp 4 EUFAM expired February 2021,

I applied for permanent residency last augest 2020 , 6 months before our stamp 4 EUFAM expired , in March 2021 I got 9 month temporary stamp 4 and i went immigration and they give me new card says stamp 4 and expires on 12 December 2021 .

I need advice now do I need replace my current temporary stamp 4 or not please advice?
The new card I have seen and says article 50 instead of stamp 4 , what does mean article 50 and any advantages about replacement card
You don't need to apply for new card anymore coz your Stamp 4EUFAM already expired and you already have temporary Stamp 4.. You just need to wait for PR which will be issued in the form of Stamp 4 instead of Stamp 4EUFAM.

The card replacement scheme is only for dependents of UK Citizens who have a valid Stamp 4EUFAM post brexit. As Stamp 4EUFAM is not valid for the aforementioned dependents, hence the need to apply for the exchange of Stamp 4 TEU Card.

Hope this clarifies.

The card that beneficiary of a successful PR application will receive in this scenario is withdrawal agreement beneficiary card valid for 10 years.

Sorry again to ask you what you mean by hence the need to apply for the exchange of Stamp 4 TEU Card?

So do you mean I have to change my stamp 4 for stamp 4 TEU card or my temporary stamp 4 is fine for now ?

I really appreciate for your advice

As mentioned and the bottom line is, you don't have to apply for the exchange of your existing Stamp 4 as the card exchange program doesn't apply to you.

I hope it helps.

I applied for a replacement card for my 4EUFAM which was due to expire on the 29th of April, 2021. I received the replacement Irish Residency Permit – IRP card and it still had an expiry date of the 29th of April, 2021 which is roughly about 3 weeks from today. I am a permanent resident (this was approved 3 years ago) and i fall under the withdrawal agreement because my partner is a UK citizen.

why does my current IRP Card still have an expiry date of the 29th of april - same as my old 4eufam card.. i thought it would have been longer like 10 years

If you obtained PR EUFAM 3 yrs ago which should have been valid for 10yrs (till 2028), can you clarify the reason for the expiry of the card this month? Unless you were issued orignal PR Stamp till April 2021 instead of 2028 because of the expiry of Passport perhaps?

You answered your own question then.

Have you applied for a new passport? Have you informed INIS of your new passport details as set out in the Q&A document?

please do you have a link to the q&a section. Quite impossible to get a passport because of the covid 19 restrictions.

The expiry date of an IRP card cannot exceed the expiry date of the passport. The basis on which the IRP card is issued is irrelevant. You must have the passport renewed before you can get the remaining 7 years.

The link to the FAQ document is on INIS's home page. Here's the document:
http://www.inis.gov.ie/en/INIS/Immigrat ... 9-FAQ4.pdf
Q 53. My permission was restricted due to the expiry of my passport. Can I use the online system to claim the remainder of my permission on my new passport?
A. No. Please do not apply for the remainder of your permission online. Applications for the balance of permission previously granted should be submitted by email to the Registration Office at burghquayregoffice@justice.ie. There is no charge for this service.

Hi All,

Just to inform you guys that I received a temporary permission to reside in the state again until Dec 2021 for the EU3 application which was submitted in May 2020 by email yesterday.
On the email it stated : “ This office will be in touch in due course regarding your application”

And on the letter , “ to obtain the temporary permission we need to report to Burgh Quay but attendance is made by appointment only. To make an appointment, go to ....BUT ITS BLANK? May be because of the level 5 restrictions that why it’s blank??

It’s so confusing and EU treaty Rights told me to email Burgh Quay if I have any further queries in respect of
registration of my permission should be directed to
burghquayregoffice@justice.ie

So I did and got a response from Burgh Quay Office stating : “All online renewals for the Dublin region are now processed online. Please use the online renewal system at inisonline.jahs.ie”.

My question now:
Do I need to re-submit my application again ??

Any reply much appreciated

Best
Jean

You need to wait for Burq Quay office to open to get the Stamp in person. That is the only way in your scenario in my opinion.

Hi Raja.brit

Many thanks for your reply.
I was thinking that too but sometimes they never give you a simple answer in reply. I think they just copy and paste a temple to everyone.

Will let you guys know if I received any update.

Bit of an unusual issue this one.

My spouse is a NON-EU citizen here on the Stamp 4 EU-FAM card based on my UK citizenship. He's applied for Irish citizenship in 2020 and we were hoping that this might happen before the end of 2021 to avoid having to make the change with the IRP card. It might still happen but given recent delays it seems maybe not and I believe there is only until the end of the year to put in for the card replacement programme.

So the issue is that the Card replacement application asks for the current passport of the British Citizen the permission is dependent on. While I remain a British Citizen my current passport has expired earlier this year and I wasn't intending to renew it given I now have an Irish passport. Is there any way around having to renew my UK passport to fulfil this criteria?

Alternatively since I am now an Irish passport holder can the permission be changed to a standard Stamp 4? Or would this be more complicated.

Any advice on this issue much appreciated.

The EU Treaty Rights require the person to have an ID that identifies their citizenship. For UK citizens, because there is no national ID, a valid passport is the only acceptable proof. You could attach both the expired British passport and your up-to-date Irish passport, along with a cover letter that explains the situation, but I doubt if they would accept it (as the spouse's permission is dependent on you having a valid British passport).

And yes you can change it to a standard Stamp 4. If you live in Dublin, just create an online renewal application and in the comments section indicate that you are now an Irish citizen and wish to sponsor your spouse under domestic Stamp 4 route. If you live outside of Dublin, call/email your local immigration Garda station to book an appointment.

Keep in mind that a normal Stamp 4 comes with fewer rights and more obligations (e.g. the holder can only stay abroad for 3 instead of 6 months; the holder's sponsor must be able to demonstrate that they have earned 40K over the past 3 years; the holder must renew it every 3 years etc; the holder is always 'dependent' on the sponsor whereas Stamp 4EUFAM holders become independent after 5 years etc).

Of course, if he has already applied for citizenship and he doesn't have anything that may negatively impact his application, go for a normal Stamp 4 is the easier option.

Thanks for the response and very helpful advice littlerr, am I right in thinking that regardless of which route we take, if citizenship is not granted by the end of the year then the application for the card replacement program (or change to stamp 4) needs to be made by December 31st 2021?

Yes the deadline for swapping the card is the end of year.

In theory, the current 4EUFAM card ceased to be valid from 1 Jan 2021. Without a new card, in theory, he is not supposed to work. However. As there was no transition from the old card to the new card, this whole year is essentially the transition period. UK beneficiaries are supposed to swap their card as soon as possible, but I don’t think it will cause any issue if you simply wait till the last day (unless someone opens a legal challenge - which is very unlikely).

I have a question that is sort of related to this. I am a Canadian on a Stamp 2 (applying for a Stamp 1G soon) but I live with my UK partner and we have been living together for 6 years. We are planning on getting married soon but not this year. Will I be able to apply for a stamp 4 on the basis of marriage to him after 2021? I haven’t got any concrete answers.
