Hi,

May I ask anyone receive the final decision recently? Deadline of my application written in the letter is 10 April 2020 but til now have not heard any from INIS. I emailed them already and got the reply: “since your temporary permission up til 10/07/20 ... a decision on your case will be issue in due course.”

- I applied EU1 form and the office received - 11 Oct 2019

- First letter from INIS to grant temporary stamp 4 and request some docs - 2 Dec 2019. In this letter, it is stated that the decision is due by 10/4/2020

- I got stamp 4 temporary residence card at the Registration office on 5 Feb 2020. Valid til 10 Jul 2020

Clearly it is over 6 months since the date I submitted my application. I wonder if anyone has similar experience. Should I keep waiting until my stamp is expired?

Thanks everyone.

Hi 👋

There is similar situation happening to me at this stages

I applied January 2020 6 weeks latter I emailed them and asked if they got my application a day latter they replied and told me we received and they will issue acknowledge in 8-10 weeks dua too many applications.

When i reached 2 months plus I sent them an email again luckily same day they issued acknowledge with temporary stam4 and requested additional documents via email but i wait more than a two months now they said decision date will be a September 2020 which is brand new 6 months of process.

Imagine 2 months of nothing they just keep a site for the applications, my advice is just keep emailing them every second weeks to get an updates.

This looks to be the expectation. That you will just have to wait until your stamp expires. It will interesting to see what happens then. Maybe they have re-prioritised at the current time based on temporary permission expiry??
I found it unfair as it seems like they count 6 months from the date they issued the first letter and not the date they received my application. In total it is like 8-9 months and that is totally against Eu directive. But for now I think cant do anything but wait.

Also my husband (the EU) seems to change jobs soon and if my application is not closed already at that time, it is very likely to mess up. I read on this forum that many got their eu1 refused because the officer contacted the previous employer instead of the current employer even when they have been informed about the change. I really dont want in the end we have to pay for their mistakes.

You know I feel like they are not serious sticking with the rule of 6 months. They did give us a deadline in the letter but in reality they did not follow that deadline.

I have applied for my Eu fam Stamp 4 application through registered post on 27 feb, the Inis received it on 28 feb
I am still awaiting the acknowledgment letter. I sent them an email and they advised due to the current situation it may take 10-12 weeks. So I am waiting.
Just wanted to know if I can take up a job once I get the acknowledgement or the temporary stamp4. Or do I have to wait for Another 6 months until I get the decision.

Hi smamor,

No you don’t necessarily need to wait for the final decision, when you receive the temporary stamp 4 you can get into employment already.

Hey there! I actually applied in September last year, and my acknowledgment letter only came in the end of November as well. I’m still waiting for my final result 😅 tbh at this moment with the pandemic I think they are really taking their time tho, and everyone is in the same situation with results being delayed either.

We are still waiting for final decision for my husband. Is EU treaty rights still issuing final decisions at the moment?or we will have to wait more longer?
It's frustrating because we don't have idea what's the situation at the moment.

When will your husband’s temporary permission be expired? I have not received my final decision yet although the letter shows that it is due by 10 April.

Agreed. It is frustrating.

We also applied in December. Decision was due next month but now permission has been extended for 2 months, presumably now we should expect the decision in August.

The current climate is understandable. But we are not in a good environment at home and when possible we would have liked to move out. We are stuck because we didn’t want to make any changes to situation before decision.

Hi,

I am also in the same situation I have applied 1st of September due date was in March; however, they told me due to covid19 I have to wait until my expiry date which is 1st June. I have not got any news from them. It is frustrating and they are so bad with their updates.

Hello everyone,

Am wondering now during covid-19 crisis
After I have my initial decision what is the next step?
Since the immigration office still close for further notice
Any one experienced the same situation could tell me what should I do in order to start working?

Yes, I texted them yesterday telling them that my 12 week waiting time is over , they said we are processing ur application now, send for us ID, marriage and some basic info as if they didn't check the application,
They gave me temporary stamp 4 till Feb 21
Which is 9 month not 6

Hi,
Yeah when my visa expired I did reach out them and they replied me with answer: please right now the visa renewal is impossible to renew due to the covid19 crisis and please confirm your address and please sending your recent bills and my husband's HR's number. After this email we have provided all details and asked why are so long as my application due to 1st June and already 9 months past. They got back to us with email: your application reached the final stage and it should be ready in August and if we do not get back to us by that time please contact with update request. Now I am facing mad because this is insane what they are checking. I am living here for 6 years I have married with my husband here. We have been interviewed before marriage and all documents are fine and they can check it within the 2 months not facing a year. I cannot it is so stressful.
Any updates from your side?

It’s disheartening that even in supposed “final stage” of being approved it will still take a further 2 months.

No I haven’t hear back from them for anything yet.. That’s actually so ridiculous like, I knew it they would use the pandemic as an excuse to making people wait even longer, and the fact that our temporary visa is extended. It just seems like they are not even going through the documents that were sent before! And Another 2 months for final stage? That’s absolutely ridiculous. We are waiting for a whole year for this I just don’t think it’s possible.

Hello all,

I have been reading the posts and the Irish immigration authority is clearly violating the EU treaty.

"The authorities should make their decision to issue a residence card or not within 6 months. If they do not do so, you can call on our assistance services" https://europa.eu/youreurope/citizens/r ... dex_en.htm

The assistance services is https://ec.europa.eu/eu-rights/enquiry- ... _residence You have to lodge a complain otherwise they get away with. This service, known as Solvit, is really good. It is part of the EU commission. https://ec.europa.eu/solvit/what-is-solvit/index_en.htm They return to you in a few days. Please submit your complaint regarding the delay with specific information/correspondences. Good luck and please let us know what the outcome is.

Hi Lon999

We contacted to get the assistance and we get this information attached down below which is not helpful at all. So would you mind what should we do in this case?

Thanks

"Dear Sir,

Thank you for your enquiry.

I have read the details of your enquiry.

I hope it will be helpful and of assistance if I explain the following.
I wish to refer you to EU Directive 2004/38/EC on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States. The personal scope of the Directive is quite wide and covers not only European Union citizens but also their family members. The family members of an EU national, irrespective of their nationality, have the right to accompany or join the EU national in a Member State other than that of the EU national s nationality.
The authorities should make their decision to issue a residence card to your spouse within 6 months.

The document should clearly state that it is the residence card of an EU national family member (a 4EU fam card in Ireland) and it should be valid for 5 years (or for your planned length of stay, if shorter).

I wish to add that I am aware that the Irish authorities are experiencing significant delays regarding processing visa and residence card applications due to a significant increase in the number of residence card and visa applications. The delays are caused by the number of applications, together with the need to request additional information in many cases and the need to verify the information. I imagine this is the case with your application.

I am sorry not to be of more assistance on this particular occasion, and I believe that your best avenue is to continue to contact the Irish authorities as they are bestpositioned to respond on the state of play with regard to the application.
I hope the above information is of assistance and if you require further information you may wish to contact the following:

EU Treaty Rights Section
Irish Naturalisation & Immigration Service
13/14 Burgh Quay
Dublin 2
eutreatyrights@justice.ie

Once again, I hope the above information is of assistance.

Hi adiba169,

Just to clarify, you've applied on Sept 1 and how long after you've applied, did they give you temporary stamp?

Have they offered you another temporary stamp when you contacted them after your visa expired on June 1?

Thanks

Once again, I hope the above information is of assistance.

Hi adiba169,

Just to clarify, you've applied on Sept 1 and how long after you've applied, did they give you temporary stamp?

Have they offered you another temporary stamp when you contacted them after your visa expired on June 1?

Thanks

Hi Lon999,

Thank you for your response. I got a letter from Eu Treaty on 21th October and on the letter was pointed that my due date for decision is 01/03/2020. They have not offered any other temporary stamp. Now I do not know what we should do.

Thanks

Hi again,

You've said the following in an earlier post: "I am also in the same situation I have applied 1st of September due date was in March; however, they told me due to covid19 I have to wait until my expiry date which is 1st June"

what is the June 1 expiry date?
