Your question has been answered numerous times here if you could take the time to stroll through the past posts.

EU law, you are not required to send photo of marriage or private health insurance if working (This can trigger the Irish immigration to ask for more unnecessary documents).

They will not deny him treaty rights just because of address not in his name. Most times they will issue the temporary stamp 4 and ask for a recent proof of address.

If the rental lease or agreement is not in both of your names, you could request for a written confirmation from your rental agent or landlord to confirm you and your spouse live there, Or you could add a letter (PPSN, bank statement or confirmation) he received which has his address.

Easiest way is signing up some utilities in his name (Garbage, Electricity or Fixed phone) and submit that.

All what matters most is you the EU citizen working and having proof of address..


For EUTR1 it takes 1 - 2 months to receive temporary stamp 4 and 7 months for final approval.

Some times they might send you acknowledgement requesting for more documents then issue the temporary stamp.

Hey everyone,
I had posted my eutr 1 on 13 November 2023 still I’m waiting for my reply it’s been 3 months now I haven’t received any kind of letter demanding documents or temporary stamp from the department of justice. I’m really worried what should i do i have tried to contact the EU Treaty Rights via email but ask me about the application no and personal id. I don’t have it cuz I haven’t received any kind of letter giving me the info about it . I’m really in a tough situation ehat should i do kindly help me in this regard .

If you have not yet received your Application ID number and your Person ID number, you should include details in your email such as

*Your name
*Your address
**Your date of birth
*Name of your EEA family member
*Date you submitted your application (postal date and delivery date).

Send them via email and also registered mail requesting status, an acknowledgement letter and temporary stamp 4.

Just hope they still have your document else they can even request you to send all again.

Hello guys!

I posted my EUTR1 application through registered post on 26/01/2024, and it was delivered to EU treaty rights office on 29/01/2024.

I am currently on a type C visa which expires on 01/03/2024. I have sent several emails to eutreatyrights@justice.ie seeking their advice regarding the steps I need to take to remain in Ireland till the deicision on my application is made. However, I have still not received any response from them.

There are only 7 days left for the validity of my type C visa and I'm really worried what will happen.

Does anyone here know what I should do to be able to remain in Ireland until the decision on my EUTR1 application is made?

Hi,

Since you sent your EUTR1 application, your visa C is irrelevant. You're allowed to stay in Ireland until you receive the final decision (Even if negative you are allowed for review and they can't even remove you if an EU family member unless you are a threat to public security or order which is rare).

You should receive an acknowledgement 1 month from your submission. If you haven't received it by then, send them a registered letter requesting acknowledgement and temporary stamp with cover letter of the details i sent above for the other person.


*They seem to respond fast with registered letters. Best send them both. Remember to include same cover letter with details in your email i mentioned.

I sent my application for EUTR1 on 03/08/2023 and they received on 4th. They asked me for some extra documents on 10/10/2023 and I sent on the same day, they received on 11th. Since then I have no update. I sent them an email to ask in December and they told me “A decision will be made on due course”. Then I sent another email on 08/02/2024 which hasn’t been answered. It’s been over 6 months, will turn to 7 in a week or so and haven’t received approval or rejection post. Is this normal?

I know this process takes so long but it’s almost 7 months!

Could someone advise me please?

This absolutely normal. The approval now is between 6-8 months. In rare cases some get decisions before the 6th month.

Did they issue you a temporary stamp 4 while waiting?.

No, They didn’t issue a temporary stamp 4 unfortunately.

For EUTR1 this unusual. They are obliged to issue all qualified family members temporary stamp 4 while waiting for their final decision unless you provided them insufficient documents(eg. EU citizen employment)

By the email they sent you, you have provided them what they asked for. You need to tell them you haven't received temporary stamp 4 and you need to work/study.

Send them a registered letter and a new email again(don't reply on what they already sent you). Remember to include your application number, personal
number, address and name


The subject should be;
EUTR1 - Temporary stamp 4

You will receive a letter which confirms the day they received your application and if they are satisfied with your documents with due date. Then there might be another letter attached at the back or sent separately(if more documents requested) asking you to register your temporary stamp 4 with duration of xx xx xxxx.

Each letter will have your application number and person i.d.

Hello everyone,

Hope you all are doing well.

I received a letter from EU treaty rights division today stating that they received my application and to apply for a temporary stamp.

Below are the timelines if it's of help.
Form sent by registered post on 26/01/2024
Delivered to Immigration office on 29/01/2024
Received acknowledgement letter on 01/03/2024

Please could anyone help me with the below information.

What is the waiting time for an appointment at the Dublin Immigration Office? And can I start working by showing the letter I received?

I will be calling the office to book an appointment on Monday since it's closed on the weekends.

Not sure - probably not. Most likely employers would want to see a card anyway.

Anyone recently received EUTR1A ? I the last update for EUTR1A (specifically) I see is from @CatBrom which was last year. The data from data.gov.ie suggests the department is coping up with the backlog very well (for EUTR1A at least)
The 6 months period finishes tomorrow for me.

Hi,

Sometimes they misplace documents because there are a bunch of other applications too. That's why it's always a good idea to follow-up with them 4 weeks after submission if you haven't received any acknowledgement letter.

** I didn't mean they have misplaced yours too.

Of course, 2 different families can use same address if they also live there. All what they need to provide is proof of address. If they are not the main tenants on contract, they can provide a letter and utility bill from the rentee. If possible, a letter from the landlord confirming they live there (This not compulsory).

If they have recieved any correspondence from a government office (eg. PPSN) or bank to their address they can attach it.

No, They didn’t issue a temporary stamp 4 unfortunately.

For EUTR1 this unusual. They are obliged to issue all qualified family members temporary stamp 4 while waiting for their final decision unless you provided them insufficient documents(eg. EU citizen employment)

By the email they sent you, you have provided them what they asked for. You need to tell them you haven't received temporary stamp 4 and you need to work/study.

Send them a registered letter and a new email again(don't reply on what they already sent you). Remember to include your application number, personal
number, address and name


The subject should be;
EUTR1 - Temporary stamp 4

-my application currently lying with the deciding officer, Correspondence will issue in due course.

Does this mean another couple of months?

I sent my application for EUTR1 on 03/08/2023 and they received on 4th. They asked me for some extra documents on 10/10/2023 and I sent on the same day, they received on 11th. Give it 4 weeks and if you don't hear from them contact them again since they didn't even issue you a temporary stamp 4 which you have right to, as a qualified family member. It's abit unusual for them not to issue you a stamp 4 while awaiting unless they were reviewing your marriage.

I think with your case and from their reply, they will issue you the final decision "Stamp 4EUFam" not temporary stamp.

Did your spouse change employers during the 7 months and if yes did you update them?
