Hi all,
Just to let you know that my EUTR1A application has been refused, reason is “they are not convinced that this is a durable relationship.”

Application date:04/08/2023
Refusal letter:16/04/2024

I live together with my girlfriend since 2 years and provided rent, utility bills, pics etc. and they are still not convinced, this application took us 8.5 months and got refused.

I have two questions,
1- How long it takes EU4 review application?
2- During EU4 application do they provide a visa stamp?

My visa has been expired and they mentioned in letter that if I don’t apply to EU4 in 15 days then I might be deported.

Sorry for the outcome. EUTR4 can take 12 months.
It's highly unlikely they will provide you temporary stamp since they haven't accepted you as permitted family member.

Incase they reject your EUTR4, go for judicial review. Unfortunately De Facto relationships have slim chances to fight via external bodies.

I am so sorry that your application was rejected. same happened to me last week. exactly same reason. I dont think I can provide any more evidence so on EU4 as angel suggested I am saying they failed to consider documents provided with few new documents.

I would say talk to a solicitor.

Yes it is so sad, especially being refused after waiting 8.5 months. I agree, I provided so many documents, travel receipts, bank statements(rent paid together), even our property agency wrote for confirmation of tenancy with mentioning Xxx and her boyfriend Xxx living together. And in rejection letter they said “you could be friends sharing rent”, all the pics etc show clearly that we are a couple..

So disappointing. If you don’t have a valid stamp how do you manage to work and travel? Or just waiting like me?

Im afraid you don't. You can stay in country, but I'm not sure what's the process if you wish to travel abroad.

Im afraid you don't. You can stay in country, but I'm not sure what's the process if you wish to travel abroad.

I will advise you not to leave the state until you have been accepted as permitted family, thus receiving your stamp 4EUFAM IRP.

Another option for de facto partners, move to some EU country with your partner ( I will recommend Germany, Netherlands, France, Sweden and Portugal) , get a residence card there then move back to Ireland (If you will even wish to move back). With this you have proven your relationship in all EU countries. They share a common immigration system and will know your reasons being granted residency.

With this they can't refuse you base on doubts about your relationship

Okay Angel, I will do as you advise. I have a last question, sorry to bother you with many questions.

Do we need to resend all documents with EUTR4? I am asking because in the checklist of EUTR4 form it seems we need to submit all documents again but in the FAQ part of irishimmigration.ie says the following;

“ You can include any new, additional or updated documents that you feel may assist your request for review. You do not need to resubmit documentation that you have sent in with your original application.”

My girlfriend is French, and after being rejected by EU Treaty today, she offered me to get Civil Partnership certificate(PACS) from French Ambassador to gain residence, but problem is following part from citizensinformation.ie:
“ Civil partnerships registered abroad since 16 May 2016 are not recognised in Ireland.”

If I get this Civil Partnership certificate, then what kind of process I can go with do you think?

Civil partnership recognised in France will not be recognised in Ireland.

Maybe the only option if you both still want to remain in Ireland is get married some where easy and register the marriage in France. Then you become a qualified family member.

They resolve disputes informally where EU rights are infringed.

They will ask for you and your EU spouse documents and be a mediator between you and the Irish immigration. In some cases they can send a complaint to the EU commission.

Hello everyone,

I am desperate. I am an EU citizen(Bulgarian), and my girlfriend is Ukrainian. We arrived in Ireland on 23.09.2023. Upon arrival at the airport, we were informed that my girlfriend cannot stay in Ireland because she is a student in an Bulgaria(she discontinued her studies at the university due to financial problems). We were advised to go and check with the Citywest Convention Centre in Dublin.

At Citywest, we were told that she cannot stay here because she has an Bulgarian temporary residence card(that expired in November 2023) and doesn’t qualify for temporary protection, her family still lives in Ukraine. We were advised to write to the Garda in our county. We did, and they advised to send form EUTR1-A to the Department of Justice, EU Treaty Rights Division.

We filled out all the documents(EUTR1-A) and sent them to them. We waited 5 months for a reply. Today, we received an answer that we need to submit more documents, such as:

- Evidence of cohabitation in my EU country (tenancy agreements and utility bills)
- Evidence of a durable relationship (shared jointly-onwed assets) shared bank accounts or insurance, evidence of travel)
- Evidence of key dates in our relationship
- A written explanation of why we started living together 1 month after the start of our relationship

In my country, I was unaware of the necessity to retain my tenancy agreements (with the agreement being solely in my name). Our customary method of payment involves cash transactions, and we refrain from utilizing banking services. Providing evidence of specific dates poses a challenge; however, photographic documentation may serve as a feasible solution, considering the difficulty in recalling all pertinent dates. We moved here in search of a better life, guided by our dreams of building a future together filled with love, resilience, and shared happiness. Our only need is for my girlfriend to be able to work so we can pay our expenses, taxes, create a family, and live peacefully.
I apologize for the length of this message, but I appreciate your attention to it and your assistance.

We are facing a pressing deadline of 15 working days and would be extremely grateful for any advice or guidance you can provide to help us navigate this situation.

How long have you been living together?

Did she get a residency card in Bulgaria on the basis of your relationship or via other means?

Hi SimeonAngelov,

Judging from what you posted, it's highly likely they will reject your application. Your partner's best option was the EU temporary protection.

Your partner would have been better of securing a residence permit as a partner of Bulgarian citizen in Romania or Croatia easily then use the residence card to enter Ireland.

Still provide them with the documents you have.
Normal Asylum application is also an option.

Hi guys,

I have a concern about my partner's stamp 4 application related to Health Insurance. We applied on the option of enough financial resources.

We arrived at the country and contracted a 12 month Health Insurance with VHI. However, when I started working, my company offered me and to my partner their Health Insurance (also with VHI).

My expectation was to keep both insurances, specially because we had already sent the first policy on the application. But, VHI canceled the first one and said that only my company policy would be valid, as it is the most benefical.

I sent the new policy to the immigration. However, it expires on July (less than 12 months). My assumption is that once it is my companies policy, it has different expiration and renovation date. Well, having a Health Insurance with less than 12 months can be a problem to my partners visa or to register with IRP?

What do you suggest me? Should I ask immigration to change the application from Enough Financial Resources to Work? How would i do that?

Has anyone received any letter for De Facto Partnership, recently?

We're extremely distressed, since the beginning of December our documents were sent for Stamp4 EUFAM via EUTR1A.

We haven't heard anything from immigration. 5 months with the life stuck.

Last email they answered was in March saying the process was queuing for analysis. Since then, they don't even answer emails.

Does anyone have any idea about what we could do?
