Hi @Claire2021,

First of all I am very sorry to hear that. I should advise you to go to a lawyer that knows immigration matters. I assume you also applied for naturalization and hopefully that will come to end soon. However, even if you start the divorce process, I guess it will take a lot of time and check with lawyer if you need to inform department with the separation if that’s happening now.

I’m sorry to hear that. Here’re a few points that will be important to you.
- From INIS’s perspective, cheating itself does not violate or contradict any immigration related matter. This means, as long as you are still living at the same address and married, INIS doesn’t care that your husband is cheating.
- You could initiate a separation process. If that’s what you intend to do, you will need to inform INIS as soon as it happens.
- Try to gather some evidences of your husband cheating on you. This could be very important for both divorce proceedings and your immigration status.
- Now the immigration bit: subject to you meeting all requirements in the past 5 years as an EU Treaty beneficiary, you are considered a permanent resident from the 5 year mark. This status is *independent*. You do not need to be in a marriage with anyone with this status. This means, having a divorce / separation now should not affect your residence rights at all.
- However, the actual practice is that INIS will not recognise you as an independent permanent resident until your EU3 is fully approved. The application may be further delayed if you tell them you have been separated now.
- You do not need to find a solicitor now, as your immigration status should *in theory* already be an independent permanent resident. However, if INIS gives you any hard time without legal basis, you can then find a solicitor and sue INIS.
- You may want to find a marriage solicitor in case you want to go for separation / divorce.

You and your husband have been living together in the state for a period of over 5 years as a couple, so you already have a right that is independent of him.

However for the sake of your child, it may be best to determine if you are able to salvage anything from the marriage or look beyond the infidelity.

The above means that once EU3 is approved they will not issue stamp 4 eufam but only stamp 4?

But so, if they issue Stamp4EUFAm, why the residence permit would be independent of the relation with the EU national? I am a bit confused now...

Hello Everyone,

Thank you so much for your reply,

I don't have pictures or videos' I found him sending messages asking and talking about sex with women , which gave me the explanation for spending many nights outside the house and the money spent.

I have contacted solicitor yesterday and he advised me to wait and take my time thinking and not go for separation now and wait for my Eu3 as it might take few weeks only ( hopefully) , he sent a letter to immigration and now I am waiting.

would you mind sending me a PM with some info on the solicitor and which kind of letter they have sent to EUTR? I would like to do the same because we need stamp4EuFAM and we applied in March 2020.

Stamp number is just a stamp number. It doesn’t mean anything other than telling the officials what permissions and entitlements the person has.

Anyone who has exercised EU Treaty rights for 5 years is an independent permanent resident regardless of anything else - EU or non-EU, employment or on benefit, have minor criminal history or not etc.

No, no news at all, applied by post in March 2020, in the last email they said it is still "processing".

Same here, i applied for an EU3 back in October 2020.
So far i haven't received anything just an acknowledgement that your documents have been received.
Stamp4 expired in Jan 2021. No further temporary stamp received. Gnib card is also expired and cant even travel anywhere.
Just passing time on an automatic extension until September this year.

What valid permission? Cant even travel. Doesn't make any sense at all.
Do you think i should email to get a temporary extension? Is that how ut works now?
Usually they send a letter by post while you are waiting on your decision we can get a temporary extension.

I never received postal acknowledgement by post n only email confirmation. You may ask for Stamp 4 extension by email in case you plan to apply for Citizenship to minimize the gap in Stamps.

Citizenship was applied in Februrary 2021, They returned my original passports alongwith an acknowledgement in 3 weeks.

Meanwhile i am still waiting for the eu treaty to send my some sort of temporary extension so i can travel.
But is it not like this that when you apply through a solicitor than they become your representative and they should be requesting temporary extension? they are getting paid for it.
or do i write an email myself requesting a temporary extension ?

Yes email EU TREATY directly for Stamp 4 extension. I emailed them yesterday for another matter n got an email from them today to contact them few weeks before expiry of permission and they would issue Stamp 4 extension.

I assume they will issue temporary stamp4 not eufam.
Do we need re entry visa after we get that stamp?

Also, i applied on the basis of being separated with my spouse not divorced.
Would they issue a letter so i can apply for the stamp myself or would their still be a requirement of myself and the eu citizen to register at the garda station to obtain an IRP card? I cant do this since we are saperated.

Hi @griffith, I can answer to this as we are in the same situation.
They should issue Stamp 4 only, not EUFAM, since the decision is still pending.

Re entry Visa is not required with the IRP card :

"From 13 May 2019 visa required nationals who hold a valid IRP/GNIB card will no longer need a re-entry visa to travel to Ireland. Their IRP/GNIB card and passport will be sufficient. This brings Ireland in line with other EU Member States."
