Extension stamp 4 eufam

Hi

A question of behalf of a friend.
GNIB card is expiring at the end of this month, Stamp4 EU FAM.
Retention application is submitted, but no reply yet. Submitted all requested documents.
Is it possible to get an extension on stamp 4 eu fam until retention decision is made? Cannot work after expiration of GNIB card :(

Yes I think you can request the department to provide you with a temporary stamp while the application is under consideration.

when your friend submit the retention application and when his/her stamp 4EUFAM is going to expire??

these days department is taking 10 months for decision of retention application.. I also submitted application last year Oct and still waiting..

Can you travel on that temporary stamp?

Submitted, last month.
Stamp 4eu fam will expire, tomorrow....

Always apply for EU3 application atleast 6 months before the expiry of your current Stamp4EUFAM. It's even mentioned in their website.

I applied 7 months before the expiry and my EU3 application is still pending, 7 months gone. My employer requested me to provide a new stamp 4, so I immediately contacted them and they issued me a temporary stamp 4 for 6 months, so I can continue working. The Gardai helped me as EU Treaty Rights were not responding to my emails or letters.

My friend spouse, has not left country.
My friend is not divorced.

that post is confusing..
1. your friend submitted Retention Application which is EU5 form not EU3..
2. Retention will not proceed or might be refused as your friend is not divorced. and Decree of divorce is mandatory for retention application. check the require documents ( http://www.inis.gov.ie/en/INIS/form-EUT ... -EUTR5.pdf ) also Read Q18(http://www.inis.gov.ie/en/INIS/Pages/EU ... tsFAQs#Q19)
3. lets assume he/she applied EU3 Permanent Residency, and he/she not living with spouse. still application will be refused as first he/she will need to apply for retention EU5. read Notice on Retention of Rights cases ( http://www.inis.gov.ie/en/INIS/Pages/EU+Treaty+Rights )

He is out of work now, as he wasnt able to provide an updated stamp to employer.
He cannot apply divorce because they are not separated for 4/5 years.

Like normally when you submit all the documents and and your visa is going to expire in that case they send you temp stamp. No would you confirm from your friend did he received the Acknowledgement from the department & if so what was written in that??

His application will be rejected for sure. would you mind to tell where your friend OR spouse is from?? they can divorce from ther countries, before 5 years.. let me tell you something he will be out of job for more then year or two if he will apply divorce here..

He doesn't have to apply form 5 if his spouse still living in Ireland working or exercising her eu right you don't have to live in same house to prove relationship just apply permanent residence form 3 and sand them all

Thanks for your sharing. Do you mind to share more details about the case? Because my stamp 4 EU fam is going to expired next year, and I m trying to apply eu1 again rather than apply eu3. I m not living with my EU spouse at the moment. As you mentioned, I don't need to live with my EU spouse to exercise the EU right ?

My friend was non eu with a eu spouse, left Ireland.
I really dont know, what the option will be for you.
There are far more experienced friends on this forum who might can help you.
