Family Permit for Parents, British in Ireland, Please help!

Post by mchowdhr » Mon Jul 20, 2015 10:46 pm

Hello All,

Thanks for the members who have been great help to everyone seeking advise.
Please can someone help me in regard to my non-Eu parents application.

I am British citizen, got job in Ireland since 29th of June 2015 but moved physically on 16th of July 2015 as I work from home. I want to apply for my parents visit visa from Pakistan under Eu Directive exercising my treaty rights. Please anyone can tell me what documents I need to submit? What are current processing timelinse for this visa?

I have found some information after reading loads of posts which is below:

1) Need to apply for Visit visa cat-C
2) My passport photocopy and parents original passports
3) My birth certificate along with parents and their marriage certificate
4) Dependency proof ( I am not sure as I couldn't find clear answer that do I need to submit now or later once they are in Ireland for residence card?)
5) Reason of visa (Shall I mention that we shall be travelling together or they are joining me?)
6) Job contract ( Do I need submit or not?)
7) Tenancy agreement

Please anyone can guide me. I would be grateful of your help.

Thanks.

Everything you quote is correct, and you must send proof of your job yes, i.e contract, pay advices would be normal and state that they are joining you in this case.

The dependency point is key, you must show that you have been supporting them at least very recently before the application. Western Union transfers and the like showing that the support you provide meets their essential needs.

Perhaps someone with more experience with the Irish EC treaty rights visa applications will comment to assist you.

Great Many thanks for your reply and help.

Please may I ask if anybody can elaborate further on it? Do I need to make some sort of their budget to show how they are spending money on day to day basis?

Also, Do they need to get any sort of insurance for this three months visit visa? Comprehensive sickness insurance, is it for 5 years residency card?

I would be grateful of your help.

Thanks.

your idea of the budget would be very useful to evidence dependency. No insurance should be required for the trip, though bear in mind the health service in Ireland works on a different basis to that of the UK so health insurance would be prudent to have.

Your parents will only be able to enter if you can demonstrate they are permitted or qualifying family member of you, within the meaning of the national legislation.

You will need to demonstrate that the circumstances is such that, they will be unable to meet their essential needs without your support

Thanks Obie for your kind reply.

I shall be providing my birth certificate and we have in Pakistan called Family certificate which show names of all family members along with my parents birth certificate and marriage certificate, I guess these all documents can prove that they are qualified family members.
For their dependency on me, I have western union receipts dated back for last five years along with bank transfers as my father stopped working more than five years ago.
I have no family member right now in Pakistan to look after them as my three siblings are in the UK and I am the eldest one and it is my responsibility to look after them once they are old and frail.

Please advise do I include any cover letter explaining all this that I have been supporting them for last five years since he stopped working and also there is no one to look after them back home?

Thanks as always for everyone on this forum who take their precious time out to help people who are in need of help and advise and we save loads of money in solicitor fees.

Regards,

Mchowdhr

hi mchowdhr,

can you please share your experience as I want to apply for my parents as well from Pakistan ?

About the dependency what I know is that if they are applying for visit visa then there is no need to provide the detailed documents to prove dependency as purpose of visit visa is only to visit family but those documents will require at the time of applying RC in Ireland... is that correct?

Any one can please share his/her experience.. thanks

Sorry I was extremely busy so could not check the post.
My parents applied from karachi, Pakistan on 31st of august but still no answer yet. Gerry told them it can take 6-8 weeks now a days. They submitted my passport photocopy certified by irish bank, my bank manager did for me, my original birth certificate, parents original birth certificates, parents original marriage certificate, original family certificate all certified by foreign ministry in karachi as it is mandatory requirment now.
Few years of western union receipts and bank transfers to prove dependency and detail budget to show how they live on my support.
Cover letter to explain eu directive exercising my treaty rights and one cover letter from my parents in support of application. Also, tenancy agreement, electric bill and my job contract.
I have not heard anything but will update you all once I get the answer on the applications.

Hi Mchowdhr,

Have you got any response of your parent's application?

@Momi007, you will need to fill two separate form but when you will submit at Gerry you will submit in one pack.

No response yet on my parents application. Thinking of to bombard them with emails and phone calls. Still no luck then will involve solvit. It ridiculous they are taking so long for genuine applications.

They're not genuine though in the eyes of the UKVI. They say they are attempts to circumvent the UK immigration rules so maybe that's why they're sitting on them.

The current processing time is 8 to 10 weeks I believe and that is what VFS has told to my parents. I hope you will get some response by next week as yours 8 weeks has already completed.

I have talked to solicitor in Dublin and he told me they used to issue visas even in one day! but since rules in UK become tougher they are receiving loads of application but also so many with fake documents which they were not aware of so they are taking longer than normal processing time (Thanks to the opportunists who spoiled them that we are facing this inconvenience) Thats why I mentioned genuine applications.
I am falling in love with this beautiful country and thinking of buying property so what on earth UKVI judge that I am trying to circumvent the rules? I have genuine job and love driving on empty motorways, compare to M25!

Well the department is acting very funny and unlawful .

I know of a recent case that was ongoing for 15 weeks, before a Judicial review claim resulted in the minister issuing a decision.

Hi Obie,

It is in fact very frustrating for people who wants to look after their old parents. What is this man called Cameroon? Is he human being or have heart? I wish when he gets older his children will not even call him let alone to take time out to look after him. He is receiving loads of bad prayers right now from children and spouses, what a load of rubbish his policies that net migration is still going up and up!
I am also extremely upset with people how applied with bad quality documents to take advantage of naive Irish visa policy and my solicitor was also furious that those people applied who did not deserve to get visa!
Obie, do you reckon I shall go for judicial review if 12 weeks passed? I dont know how long this will take further. Any suggestion? I have sent email but I know I wont get any positive reply except that cut and paste reply which others getting from them.

Yes you could threaten legal action, as 12 weeks is by no stretch of the imagination, expeditiously.

Update: I sent email to Dublin office on 28th of Oct and today I have received reply that the application of my parents who applied in karachi on 31st of Aug has been received in Dublin office on 19th of Oct!!!!!!!!
Also, it was mentioned that as a qualifying/permitted member we expect to make decision in 20 weeks (5 months!!!!!)
Is this a joke? Are they taking piss or what?
I am extremely upset with this such a non-professional behaviour and I found it rude to be honest. I am going to get Solvit involved as this is not acceptable.
I recommend whoever waiting, please do send email to check when they have received your application in Dublin office.

No update. Still waiting. Have sent documents to Solvit after they requested me to provide what my parents submitted with their application and I sent couple of follow up emails to Solvit and cant believe that they did not bother replying to me!
I think they have hired Inis staff for Solvit now!
