If you followed correct procedure they won't reject your request. You will get an email with your file in PDF format. You have a right to obtain a copy of the record they have about you.

Agree, I haven't heard anybody at least on the forum who have said that they got refused for FOI.

Shelter, I think it is a positive response, to my knowledge FOI is a right, and you should get it, but I think of it in another way and positively, they mean you will no longer require your file as you will get a decision even before the specified period, they told you previously that your application was already submitted to the minister which I take it seriously strongly, they think you will have a decision in afew days or weeks and you will be happy of their refusal , but for any reason if the minister did not decide they will send you your file.I have no other explanation, so hope all the best for you.

Thanks @alhakeem hopefully u r right about email ..anyway I applied for FOI before I got that that email from citizenship department...

Unfortunately, it's not like that. In the response, there is "have being submitted", not "have been submitted". I received exactly the same copy-paste reply in November. Last week I wrote another enquiry about my application's status and asked what "have being submitted" meant. The reply was: "it is
currently being prepared for submission to the Minister for decision but
has not yet been submitted"

i am thinking to request for FOI just to know if they really make any effort or my file is eating dust somewhere behind. its been more than 2 years :?

I just got a quote from a known solicitor agency.
Solicitor's professional fee is 5200 Eur plus VAT.

To make a Freedom of Information Request (FOI) you can either email or mail in the application (along with a copy of your ID) to the department. The FOI will show you what's been done to date on your application. It takes a few days for the department to acknowledge your request via email (you will be issued a reference number). After that it takes about 4 weeks to receive the FOI documents. Making an FOI is free.

To find a solicitor google something like "Dublin Immigration Solicitors" and it'll pull up all the options and you can read the google ratings and reviews, where people discuss their case etc.. You can't share lawyer contact details on here.

On a related note: I've noticed people have different theories about how long one should wait before going through the courts to force a decision - I've seen everything thrown out 4, 3, 2, 1.5 (years) etc... This all seems like a personal preference as opposed to what the courts favour. From my understanding you can take your case to court once your application has exceeded the amount of time the department has advised. At the moment they are telling everyone it'll take 1 year (except for the people who applied during the pandemic). Therefore theoretically, after 1 year you can start the process.

For the people who have gone through the courts - have your lawyers made any comments regarding how long one should wait before making a case?

Even if you go to court after 1 year you still have to way long time more as the court process it’s a long story , first you have to sent letters to government so that’s gonna take 2-3 months second you have to start the court cAses they will leave you a date for a court hearing, after that there will be couple of weeks to do different days of court hearing untill both parties agreed for a decision in time agreements which all this are gonna take you 1 more year

so start the process after 1 year or 1.5 years has passed, as everything takes time. The steps are then:
1. FOI - takes about 1 month
2. Get a lawyer to send letter to the INIS - 2-3 months
3. Get a court date -?
4. Get a decision from the courts -?
5. Wait for the INIS to send finalize application decision as ordered by the courts - ?

How long did you process for all of the above take in total?
