Hello can I get stamp 4

Hello I have applied for the stamp4 with doj My wife s English and we live in Cork She is not working and is waiting for an appeal decision for jobeekers allowance.they refuse her for js allowance because they say she not habitual resident. she is on fas evening computer course .she get social welfare allowance while she is waiting for her appeal.
DOJ have asked us to send what benefits she is getin

Should we send a copy of appeal letter and refusal letter from sw.?
and a letter from the cwo stating what sw my wife recive?
if we send this will they refuse me my 6 months stamp4?
I have no visa at the moment and the Doj no that.

  • Has your wife ever worked in Ireland?
  • How long has she been resident here?
  • What have her activities been up to now?
  • Where did she live before coming to Ireland, and for how long was she there?

my wife is a British citizen and has lived in uk all her life
she has not worked in Ireland she is on SW. payment. She came to Ireland in Feb 09 and is jobseeker. thanks

Jobseeker's Allowance should be payable then, since she has been resident in the Common Travel Area for at least the last 2 years (usual definition).

However, as she appears not to be exercising an EU Treaty right in Ireland, your wife is not resident in accordance with Directive 2004/38/EC and so your right to reside is also not in accordance with same.

Your wife must be a worker, a self-employed person, engaged in a course of study, or be financially self-sufficient.

Thanks but they did not give me nothing not even a temporary 6 month card or stamp 4

This is because, from the information you have given here, you are not entitled to it.

You have the right of residence under the EEA regulations only if your wife has the right of residence under the EEA regulations.
