IRP status clarification

Hi,

I married my spouse (who is outside the EEA) in a non EU country in April 2022.

After several months obtaining the visa required to come to the State, she arrived in November 2022. She received an IRP with Stamp 4 conditions in January 2023.

However the marriage has been catastrophic, and i won't go into details, but I felt compelled to leave my residence in August 2023. There is no prospect of reconciliation. I have filed for legal separation on the grounds of unreasonable behaviour and the absence of normal marital relations.

In the meantime I got a job offer to work abroad, and that since October 2023 I am no longer working in the State. I am currently seeking residence abroad also.

With the information provided above, I am interested in the status of my spouse. Does she still have the right to reside in Ireland if I am outside?

Also is it up to me or her to notify INIS of the current arrangements?

Not on the basis of your marriage. However, nothing stops her from finding another way to stay here, ie through work permit.

Should be her, but you can do it as well. ISD was supposed to be notified within about a week of you moving out.

She would not qualify for a permit under other conditions.

What happens if immigration support are not notified within 10 days?

Then, technically, it's a breach of conditions for her permission. But until her permission is up (and she cannot renew it), ISD has no reason to enquire about her status.
