But he has no valid immigration status/visa now.
Can he still apply under 4.7 ??
Visa is not mandatory.

If he came on student visa, has strong roots in Ireland etc living here for very long time, tax payer , no burden on state, family here, school going or Irish born kid.

As you can see from this link its kind of clear person should need to have valid permission if they want apply under 4.7.

That page updated January 2016 as you can see bottom of the page.

That's the minister policy before April 2018 and they didn't update after judgement.

Hi,

I have applied for this scheme in December. I was told by one of the migrant support group that some people who were denied permission until now had a different status during their residence. I dont know if they make exception to this eligibility criteria since they specifically state you should not have changed your status to any other status other than student.

I also find its quite frustrating to wait all this time without being able to plan the future. I am hoping to hear from them in March.

You know I have been praying and hoping that one of us in here would tell us they got response,as that would have given me hope.I stopped working( my visa expired 04/10) since October until now, small savings that I had are now drained.I thought 4 months would be enough for them to have responded but I was wrong.I feel lost, confused, alone and scared of how Im going to survive if I dont get response before end of March.

I have emailed them asking how far they were with my app or to atleast estimate waiting time, no reply yet.I apologise for pouring my fears/frustrations on you, I just thought you will understand better since we are on the same boat.
I wish you all luck and pray we all get approvals asap.God bless you.

Hi Brianah,
I understand your frustrations as I'm in a somewhat similar situation except my current 1G permit expires at the end of May. I have a short term job contract which also expires at the end of May after which I'll be relying on savings to survive. I log in every day to check for updates and reassure myself that all hope is not lost. Hang in there because I strongly believe you'll have a reason to smile soon. I hope we will hear from them by the end of March. Stay strong, hugs and God bless....

Hi Mark_ir,

INIS received approximately 3,100 applications and made a decision in approximately 560 cases till 12/03/19 according to Minister of Justice.

What you think how long it going to take to complete all applications ? Very disappointed.

Hi dubnew, do you mind sharing where you got that information? Can't find anything online.
Have a friend who applied end of December and was hoping to hear back in the next few weeks. Now looks like a much longer wait.
Best of luck to all of you in your applications.

For Written Answer on : 12/03/2019
Question Number(s): 216 Question Reference(s): 12xxx/19
Department: Justice and Equality
Asked by: Eoin Ó Broin T.D.
______________________________________________

QUESTION

To ask the Minister for Justice and Equality the progress to date in considering applications under the special scheme for non-EEA nationals that held a student permission during the period 1 January 2005 to 31 December 2010; and when the remaining applicants can expect a decision.

REPLY

I am advised by the Irish Naturalisation and Immigration Service (INIS) of my Department that the Special Scheme for Students closed to new applications on 20 January, 2019. INIS received approximately 3,100 applications comprising former students and their family members. To date, INIS has made a decision in approximately 560 cases.

The Deputy will appreciate that it is necessary to process such applications in compliance with legal requirements and in accordance with the Scheme criteria. While every effort is made to process applications as soon as possible, processing times will vary having regard to the overall volume of applications and the complexity of individual cases.

INIS has already taken a number of measures to address this cohort of complex cases including the introduction of an on-line application facility for the Scheme to make it as streamlined as possible for applicants. The resources available for these activities, which includes the provision of overtime, and the accompanying operational and organisational structures, are kept under ongoing review to ensure that applications are processed as efficiently as possible.

Hi,

Do you know if they only started processing applications after the Jan. 20th application deadline? It might explain why they have only gotten through 560 applications between Jan-March. If they started processing application in October when the call for application was made then it is scary that they have only processed 560 applications between Oct-March :(. At this rate, they might need all year to get through all 3,100 applications. This is very bad news!!!

Could you not email them to ask if there was any way they could expedite this for you if the wait is long? It is frustrating.

I only applied mid January and I was counting on hearing back by March/April/may ..max!
