only heard some cases who changed to eu fam are being rejected. don't know others.

Same from my side. Few cases who has changed to Eufam got refused.😭😭

they can easily take upto 2 years to process all the cases. it doesn't look like a special scheme but more likely it turns out to be a "leave to remain" application. for what they have changed 700 euro ?

I got refusal this week for student scheme , Reason for refusal is that I have changed my stamp to stamp4 EUFAM. I applied on Dec 21st, 2018.

My friend met to solicitor, and solicitor said if they refuse visa for student scheme because of stamp 4 EuFam and if your stamp is void(null), it means it does not exist then last stamp which was existed is Stamp 2, we can ask them to issue visa based on that.

Anyone has knowledge about this, Can we really challenge INIS to JR on this base or this solicitor has no knowledge?

Sorry to hear newstylee,

I think you should make change of status application 4(7) rather going for student review. You know how INIS considering EUFAM application these days and specially if you are from certain South Asian countries.

You are living here long time and has Irish born child too. Your change of status application will be more stronger then student review, I guess.

They are doing same with everyone who has changed their status especially EUfam.You can review your file but very less possibility to get any positive outcome of it.
Better to apply under section 4.
Any update about your zambrano application??

dubNew, it is now very much understood that they are not granting visas to eustamp 4. i have a friend of mine who came in the country in 2006 and remained on stamp 2 till 2013. he changed to stamp 1 work permit for a year and then he couldn't extend that stamp any further. department then gave him another 4 months temporary visa to look for a 32k job to secure the permit but he couldn't do that too. then he applied for leave to remain and still on it. he has also applied for this scheme and waiting for the reply now.

at the end he remain.on student visa over 8 years a.d then for a year changed to stamp 1. what you guys think will happen with him. after all his status was changed . please share your opinions.

Under their stupid eligible criteria he might will get refused.

3.4 is clear on that. Unfortunately he changed his status to stamp 1 and this is an essential requirement for the scheme. I will be surprised if he gets positive response.

yes, you are right. it doesn't matter how many years you have stayed on student visa, once u have changed status, u r out.

if the eufam stamp4 was revoked, but the fact is it was still existed at one stage. main thing is stamp 2 was once changed to stamp 4 and then it was revoked because you probably couldn't provide enough evidence and reason to not to revoke it and it makes it even worse. it indicates that it was a sham marriage. so, I don't think on this base you can challenge it. but some solicitors are saying that they are gonna challenge these rejections on other bases. for example; if you enter the state between 2005 to 2010 and you remain student until or after 2011, you should be eligible for it. in 2011, the new student timeout law came where student can't stay over 7 years. now, supreme court whole decision was based on that law that if someone entered the state on student visa before 2011 he was not aware of this 7 years cap so he should get visas etc.. now they have made a silly law where change of status matters them. I think all people who entered state between 2005 to 2010 will somehow at some stage get through. my advise is contact some best lawyers in the town and I think you should appeal this to this again.

Most students who got stamp 4 on marriage basis before 2011 are citizens by now. If someones stamp 4 got revoked after suspicion of sham marriage, they cant expect them to grant legal status through this scheme as it explicitly states they do not qualify. INIS came down hard on sham marriages in recent years and they are aware of such individuals potentially trying to use this scheme after their permission get withdrawn. They might however consider individuals who were on stamp 1 as it is a natural progression from Stamp 1G or stamp 2.

My friend got refused last February under student scheme for the same reason as your.He reviewed his file and last Friday he got refused again.
So its clear that if you review even wouldn't get any positive outcome of this scheme.
