Partner of Critical Skills EP holder on WHA

Post by joneswings » Sun Aug 11, 2019 5:08 pm

I'm the de facto partner of a critical skills EP holder. We're both American. I'm here on a WHA that I was hoping to convert to a critical skills EP, until I learned that I can't do that while living in the state.

I just saw this: https://www.citizensinformation.ie/en/e ... cheme.html

Are there any gotchas about having a WHA and doing this while working with the WHA? Are the processing times the same as for other EPs, as seen here: https://dbei.gov.ie/en/What-We-Do/Workp ... rmits.html

When you say you are the de facto partner, is this approved by INIS or is it simply that you are living with your partner?

If you don’t have an approval from INIS, you will need to fill in the de facto application, have it witnessed by a solicitor, collect proofs (proof of living at the same address for more than 2 years, proof of relationship and proof of financial interdependence) and send the application to INIS.

It took about 6-9 months to complete the application and you will need to have a valid status (be it WHA or something else) at all times while your application is in progress.

Once you get your approval from INIS, you will get a Stamp 1G which will allow you to work without a work permit.
