Stamp 4 based on Critical Skills Work Permit/ Freelancing

Hi Everyone,

I came to Ireland through Critical Skills WP working at IT. I am now on Stamp 4.

Can anyone help me with the following:
1- What are my rights if I leave work now, assuming I don't have a new employer for a while?
2- If I leave now and find a new work in a month do I have to apply for a new work permit as there was a gap between 2 employments?
3- Can I start working as a freelance? Do I need to set up a sole trader company for this?
4- Should I keep working at the same sector which I initially got the work permit and support letter for? forexample can I start working at coffee shop or trade online?
5- How will freelance work impact renewing my stamp 4 which is due in 8 months?

I would really appreciate if you could share your experience and knowledge of the subject. There are very limited sources available online.

1. Since you already transitioned to Stamp 4, you should be alright. If you are out of work, you should have access to state funds. After all, you have paid your due PRSI and tax for 2 years on CSEP.

2. If you have Stamp 4 you are not bound by/required to have a work permit anymore, you can work in any other profession, subject to the profession's regulatory bodies and your qualifications to assume the profession.

3. Yes , you can. And you need to set up a LLC or personal company LTD for income tax purposes at the least (if not business credibility). You should also be able to be eligible to access entrepreneurship/startup incentives relevant to your profession.

4. No you don't have to keep to the same industry. I assume since you managed to come here on CSEP based on your IT skills, your skills are still on high demand and you didn't have a life-changing enlightment overnight to become a barrista or meat deboner instead :D

5. That probably you need to ask your local INIS what documents they need to renew your Stamp 4. INIS website doesn't clearly specify and very little information about Stamp 4 transitions/renewals for people coming from CSEP track. Since Stamp 4 is given for 2 years, apparently you continued to work for your CSEP sponsor for more than a year afterwards. They would probably frown if you're drawing ie. jobseeker's allowance but if you're making money through legitimate means, you should be alright.

I was managing partner of a boutique consulting company out of another EU country before I joined my current Irish employer and thinking of re-establishing my practice here in Ireland after I get rid of the CSEP shackle. Would be very interested to hear about how things turned out for you.
