Well we got refused as well, the letter says we haven't submitted evidence of a subsisting relationship and no proof that I indeed work and reside in Ireland. That refusal has been sent ob April 10th. Since then we prepare the next application. This time I have inculded EVERYTHING. Letters from my company, payslips, banking statements, a letter from my landlord, copy of my PPS card, utility bills, Call history with my wife, proof of address that we lived together in Austria, 23 pictures of me and her traveling together, marriage certificate etc.

It is terrible that that happened because she cannot stay in her apartment anymore ... so we found a temporary space but still. It is absolutely terrible that they openly doubt our relationship and marriage though we married in another EU State. I can only hope this time we succeed but I even further lost my trust in the department complying with the EU Laws...

OMG I did not expect that. That is really bad to hear and I am sorry.
It seems now that you have included everything that needed to be included. I have included the same in our application. I really don't think you will have a problem now but the downside is that you have to be patient until you have results again and that sucks.
"evidence of a subsisting relationship" Didn't you include the marriage certificate? We only included this one. No photos not anything.

We included the marriage cert in first instance yes. Did you include anything else like proof when and where you lived together or anything else?

No nothing. Just the marriage certificate.
I've send though a lot of documents as proof of work, even tax residency. But from marriage point of view just the certificate. Now in the Stamp 4 application I have sent a few photos and proof of living together.
They are judging with different criteria. My embassy told me that if they need for more evidence they will ask.

Written very vague but yeah they didn't acknowledge our marriage cert as proof enough. Nothing I can do about but we will most likely start a lawsuit when she's there. It is actually illegal not to acknowledge the marriage cert if it's issued by another EU State

Very sorry for this bad news.

It seems you are considering to make another application. Why not appealing with only additional documents that was missing??

I am in the final stage of organizing documentation for our appeal.

Bottom line is some visa assessment officials demands more than others. You only have to read what others have submit on their application to know the system is not working fair.

Hey man,

I will tell you what I've sent, since it was successful and many you can incorporate it to your appeal.

For Job:
1. Contract of company
2. Tax form from Revenue
3.Letter of employment from company
4.Reference letter from supervisor

For House:
1. Contract
2. Reference letter from Landlord
3. Letter of Private Residential Tenancy Board

For Marriage:
1. Copy of Marriage Certificate

General:
1. Passports
2. Cover Letter from me
3. Letter from wife

That's it I think.

We submitted the Stamp 4Fam application on 15 of April.They received in on the 16th April and 2 days ( 4 weeks later) ago we have received the acknowledgment letter so we will get the Temporary stamp 4 until final decision is made.

It needs a lot of papers.I will tell you what I’ve sent and I will tell you what More I will send.

I have send:
1.Recent Tax forms (mine)
2.Bank statements (mine)
3.Utility bills in my name and in my wife’s name (Internet)
4.Letter from landlord that wife is staying in the apartment and the email from them that says that house contract cannot be amended.
5. Letter from Residency Board (mine)
6.Private health insurance (Both of us)
7. Work contract (mine)
8. Employer reference (mine)
9. Passports (both)
10. Photos (both)
11. Apartment Contract
12. Cover letter explaining what I am sending etc.
13.PPS (mine)

Now we have made other moves regarding my wife’s stay so I will send more (without them asking for more but it is me being proactive)

1. PPS (wife)
2.Bank statement (wife).She opened a bank account
3. Letter from Residency Board that she is residing in the apartment
4.My new job details cause in the meantime I have changed jobs

In General so far for me it is not challenging. But you have to be detailed and ready for gathering papers.

Ask how you can add the wife to a bill and how long it will take.If you are in dublin check the waiting time for appointments for stamp 4 cause it takes a long time.Maybe make one even before you submit them.I am not in Dublin so the waiting period is a lot less.Ask for your wife to be added in the apartment contract.

You know?in general to be ready and know what to do when she gets here so apply asap. Stud the application and see what you have to get and if you find that you have a problem somewhere,try to solve it before she comes.
