Hi guys,
I am an Eu Citizen (Greek) and My spouce is Ukrainian.We got married after 9 months of relationship, in January 2019.I recently moved to Ireland (December 2018) for a 9 month contract with a pharmaceutical company and I indent to stay indefinately in Ireland. My wife already applied for a visa C to accompany spouse and we are waiting for the feedback on that.
I understand the next step is to make EU1 application and to obtain a stamp 4 in the beginning and ultimately a stamp 4 FAM.I hope this is the correct procedure.
My worry is
1. if the 9 month contact will play part in the decision and how negative it will be.At least until I get it renewed or change to a longer term job.
2.How can I open a bank account in her name or even a joint one if she is on a C visa?
3. Obviously she will resign her job to come here.I have a pretty desent job to support both of us but how much are enough?
4.Exept from utility bills and health insurance, what other documents have you submitted to try and seal the deal?I am trying to avoid them getting back to us with more questions.
5.Should I get a solicitor to do it for us?If yes, do you have any guidance as to whom to request?

Type C is the wrong visa. It’s for short term visit. Any long term visit should have be type D.

Also if you just want to bring her over,l and you will be travelling together, she doesn’t need a visa.

I know by fact that in regards of visa you are completely wrong.You can get a short term C and later apply for EU1 if you apply under a specific category for visa C and it is very clear in the goverment site.
I also really never heard for an non Eu endering a visa required country without a visa simply by being accompanied by an EU spouse, ever in general.So eccuse my ignorance in the matter but I cannot risk the legal implications of such move.

Actually it is possible to cross border together, the eu and the non-eu spouse together without visa, with the marriage cert, but its a risky move, usually helps a lot if u have a resident card , even a non article 10 base card from any eu country, but there is a high risk of denial.

But once the non-eu spouse has a article 10 resident card u can travel together in the EU for sure without visa.

Thanks for the reply.This is why i’ve said excuse my ignorance cause I had no idea you could travel without visa but I too would be afraid for the outcome.

Based on the steps after the visa (EU1) I am asking for guidance so any suggestions would be highly appreciated.

You are right. Wasn't aware that the spouse can apply for a C visa. But as you also mentioned, type D is the one that most officers are looking for (as it indicates long term stay instead of short term).

As long as the spouse travels with the EU member, he/she does not need a visa anyway.

You don’t need a solicitor to do this. Your case is straightforward so save yourself money.

By the time INIS makes a final decision it’ll be well over the 9 month period, the very least.

Important for you is to secure a permanent job whilst awaiting a final decision for your spouse. The moment you get the permanent contract be sure to send a recorded delivery copy to INIS. For now send what you have to apply for the EU1 Card.

I’m assuming you are on full time employment and earn at least the minimum wage per year? If so you should be ok so long as you show you’re able to financially support both of you.

Get yourself and your spouse a cheap entry level health insurance as this is important to have when applying. This will further support the application by showing independence from the state even more.

Your spouse doesn’t need a bank account straightaway. As I said INIS are slow to process applications like yours which should buy you time.

Once your spouse gets the initial Stamp 4 you can start building her activities here I.e. open bank account, register her for PPSN, tenancy agreement etc. Best thing to do is get a few of these letters (2 or 3 at a time) first and periodically send them by post to INIS (always use recorded delivery).

For yourself generally speaking provide as much evidence as you have available of your activities in the state. So make sure you get everything in writing I.e. mobile phone contract, tv license, rubish collection bill payments, broadband, car registration, etc (this is just a list of examples)

Visa C application redirected in Dublin

Hi guys,

My wife applied for a visa C to accompany an EU member(spouse). She applied in Ukraine consulate which sends the applications in IE embassy in Russia. I called today and told me that because of the nature of the visa application, the application was redirected in Dublin for consideration. I guess that means it will take longer that usual.

However, do you have any idea if there is an office in Dublin I can call to ask for a status update? Or any idea how whom I can contact in Ireland for this matter?

There is no phone number for entry visa enquires in the Dublin office. There's an email there although it sometimes takes weeks for them to respond.

Would be interesting to know how long they need to process this kind of C Visa. Me and my wife are going through the exact same situation currently. I think all EU Spouse Applications gonna be redirected to Dublins Visa Office but on the Inis Website it doesn't show the approval times for that type of Visa, only Join Family which is most likely (i think correct me if i'm wrong) for the long term D Visas for Family reunification and the tourist/family,friend visas which I don't know if that can be related to as well... While deep diving I found this document on the INIS website which says max 4 weeks ...

No note that is has been reverted so if anybody knows how long the ETA is on that me and I'm sure OP also would appreciate any infos on that.

Hi,
My wife’s visa was submitted in the embassy in Russia.After a couple of phone calls,they told us that the visa was redirected in Dublin.Today I called again and they said that the visa,although it is C , its is for Joining Spouse type and therefore it can take up to 6 months.
However,they’ve said that because one of the spouses is EU then it will take 2-3 months.
These news fell like a rock to our heads cause we didn’t expect to take this long but it is what it is.
I have also emailed the visa department in Dublin.if I have news from them or any kind of information,I will let you know.

Hey,

I called the embassy in Berlin because the one in Vienna is currently not unreachable. They told me it's about 4 weeks just as my link provided stated unless they refer it to Dublin (because of their backlog) I have a theory here why that is.

Because the state your wife resides in is not within the EU they send it to HQ but I can be totally wrong here.

Can you may tell me what you filled into the application so I can compare it with ours?

Unlike your state I have a secured job over here with a permanent contract and included every bit of information about my rented accomondation, work contract, corresppondence with the EU council and my employer into the application.

So fingers crossed. Waiting 2-3 months would be a desaster ...

I think it will be one month on March 6th.

My job maybe 9 month contract but is it really highly paid so I don't think it will be a problem there. I've submitted,among others, tax forms and payslips, work contracts, employer letters, even the house contract. They'll see I've got her covered more than enough.However, I am in search for something more permanent cause indeed it will help more in general.
From what I read though, there is no minimum salary from which you get refused a visa from. I assume it should be at least minimum wage.

Waiting 2-3 months is a joke because even if you run a background check on a person, it will take less. I am hoping that we will get an answer at the end of our month time. In the meantime, I am still waiting for the e-mail response from INIS.

I have made the mistake and sent an email from my work email and they responded 2 days later that they cannot give us information because this email is not registered in their database from any application. So, I resent one from the email I put down in the application.
Once I hear from them, I will let you know.

I am writing this analytically in case someone reads it and needs some info.

When did you apply for yours?

Hi,
we sent our on Sunday and the documents are on their way so the process ain't even triggered yet. However I roamed around the russian embassy site and also no ETA for these spouse visas. However the embassy in Berlin states:

It takes approximately 6 weeks for a visit visa to be processed, 4 weeks for applications from spouses of EU citizens and 3 weeks for business visas. If you are hoping to receive your visa before the holidays, make sure that you have applied in good time.

However it doesn't say if it's for accompany the spouse or join the spouse who is already in Ireland. In theory it shouldn't make any difference at all as AVATS doesn't differ between these options.

It's frustrating that there's no real info from Inis about this.

I am hoping the German site is more accurate than the vague Russian information I have collected.

Imagine that we have submitted the application in Ukraine, from there it went to Russia, cause there is no Irish embassy in Ukraine, only consulate and, according to them now it is in Dublin. So if we take the 4-6 weeks as a time frame, It counts from when?Cause I have no idea how and when it was sent to Dublin. So it counts from when they are received in Dublin or in Kiev.
In the visa site they have some dates when they received applications but it is very complicated to identify the correct one.

it is a bit frustrating

You should be able to obtain the status and where your application is via the AVATS Tool provided by INIS?

I was able to reach the Embassy in Vienna and they told me that they need to send all EU Treaty Visa applications to Dublin so most likely ours will end up there as well. But it surely sounds like priortising specific countries if Germany can state a 4 week timeframe. Austria is a bit vague of that saying they haven't processed an EU Spouse Visa for some time and have no info on how long it takes. I try to phone into the Berlin Embassy tomorrow again asking if the 4 weeks timeframe is still realistic

Try to check the "how to apply" section at the embassy website.

Fingers crossed, the run begins ..

Arriving at the border without an entry visa

It is always best for your non-EU family members to be well informed in advance and have all the necessary documents before starting their journey.

However, if they arrive at the border without an entry visa, the border authorities should give them the opportunity to prove by other means that they are your family members. If they manage to prove it, they should be issued with an entry visa on the spot.

HOWEVER it's not clearly stated if thats for the Schengen room only. I've sent a inquiry to them asking for clarification on this. Maybe there's a little loophole we may can make use of. If it's then necessary to travel with her so it be but yeah this paragraph deep dive is making me sick....

As you said pharmacutical company there I'm guessing about that large area in Dundarrow?
