Hi guys,

I have sent another email to visa people in Dublin and I got the same standardized response that the visa is under evaluation and they have a huge volume of applications etc.

So there goes week 5 and going strong in week 6.

If they responded with that, how long will it be until you actually get the passport back???

Please keep us updated.

Hi guys,

Take a look at this post

ireland/join-spouse-visa-approved-t276918.html

Aparently,it took the lady 5 weeks to get a reply...Now I am worried. After my five weeks,I don’t even have a response if they need any additional documents...

Another message from the embassy in Berlin

Dear xxx,

what exactly is it that worries you? As I have assured you before, processing time is four weeks from the time your application is complete.

Best wishes,
xxx.

I forwarded the message from the organisation to them. Let's see if there's any outcome.
Ok I will send you the response I got from Irish Embassy in Russia.

"Good afternoon,
Visa application ..... is currently under consideration.

NOTE: Join family applications by their nature require a more in-depth consideration than short-stay visa applications. You can expect that your application will be dealt with within 6 months of receipt of all required documentation.

http://www.inis.gov.ie/en/INIS/Pages/Join%20Family

Kind Regards
Visa Office 5
Embassy of Ireland
Moscow"

I have replied that the link they've send is irrelevant to the application we have made which is under the Directive 2004/38/EC. Also, I have asked then that the girl from Kenya, got the visa in 5 weeks and and I've asked them if there a discrimination regarding Ukrainian/ Russian applicants cause it is beyond why they take so long. And obviously the Irish Embassy in Russia is completely ignorant. I have posted the link of the Kenyan citizen a few posts back

And this is the response to my last email to them:

"Thank you for the clarification regarding the Visa Type that was applied for.

Our website http://www.inis.gov.ie/en/INIS/Pages/Fa ... 20citizens clearly states that:

"Applications from 'qualifying family members' (see para. 3 above for list of 'qualifying family members') are processed on an accelerated basis. While every effort is made to process these applications within a reasonable time frame, processing times will vary, having regard to the volume of applications, their complexity and the resources available.

Applications from 'permitted family members' are not subject to the accelerated process. Processing times can vary throughout the year, due to the high volume of applications, their complexity and the resources available. While every effort is made to process them within a reasonable time frame, the processing times can increase when the provision of additional documentation is requested or a detailed assessment is required."

Every effort is made by this office to ensure that these are processed in accordance to our guidelines. To bolster this process, a special dedicated Unit was created in Dublin to deal with these applications as the numbers from around the world had increased dramatically. This assists in reducing waiting times by having dedicated expert staff process these applications.

Your application was forwarded to Dublin on 15th Feb 2019 (the same day it was received in this office) for processing. We will inform you of a decision once it is made.

I trust that this is in order and should you need anything further do not hesitate to contact us.

Kind Regards

Visa Office
Embassy of Ireland
Moscow"

So,

What I basically got out of this is that my application was sent on the 15th of February in Moscow. It was submitted on the 5th of February in Ukraine. Taking into consideration that the 15th Feb was Friday, that means that Dublin received the application 19th?20th? at best. So that puts the waiting period into a new perspective. The month I thought was a month is not one month. We should count from the 20th lets say which is time of visa received in Dublin.

I guess.

How do you see where the application is, is there any tracking portal or are you going by what they told you.

If it is four weeks from when it arrived in Dublin then we will be waiting for another two weeks at least. The problem we have now is our expected departure date needs to be changed. We have emailed the embassy to see what they advise.

There is no tracking system.
The embassy gave us the information after 10 calls and emails. Honestly, i believe that is was 4 weeks since we first applied, meaning 5th of Feb, but if they got it between the 15th-20th, at best, then my logic says that they will start the evaluation since then.

However, we were advised not to book tickets prior to the decision.

Hi guys,

Today I received a phone call from SOLVEIT.They said that if the visa has been delayed for more tgan 2-3 months, they would intervene. I then explained them that there is no waiting time specified and that we have received different information from different embassies. Then the guy said that he will forward my request to Your Europe Advice and he gave me his pgone number to contact him later. Your Europe advice, send me the below message:Dear Sir/Madam,

Please find below the reply to your enquiry. Please note that the advice given by Your Europe Advice is an independent advice and cannot be considered to be the opinion of the European Commission, of any other EU institution or its staff nor will this advice be binding upon the European Commission, any other EU or national institution.

“Dear Citizen,

Thank you for your enquiry to the Your Europe Advice service.

This service provides information and advice on your rights in the EU. We cannot act on your behalf. Where appropriate, we will refer you to bodies or agencies which can assist you in your case.

Your wife s visa should issue to her without charge or formality or delay (Article 5, Directive 2004/38/EC). The Commission has indicated that by analogy with Article 23, Regulation 810/2009/EU, such visas should issue within a maximum period of four weeks. An anticipated delay of six months is unreasonable and is contrary to EU law.

To try to expedite issue of your wife s visa by the Irish authorities, we recommend that you refer your case to SOLVIT”.

Tomorrow I will call the guy in Solvit and take it all the way. I am in week six now.
I will keep you updated.

Well they now splitted the "Join Family" Process anyway in the waiting times. They made a big leap anyway.

Nowhere that's what annoying the hell outta me. But just judging from what is happening there they seem to make a big leap in processing visas. 3 weeks back Join family has been in November 2018 and now we're end of January. Best of luck to all visa applicants who miss their loved ones and want to renunite with them

Well we are not on the list again so there goes week No.6.
Also yeah, we are not under any category which is insane. Unless they put us under Irish citizens. Which I highly doubt.
I think we are under category other because Irish and non-EU are for Visa D and we are not included for that
On the other hand, if we are under other, I should have had a result by now

Also, I have spoken again with SOLVIT and they've said that they will take the case into consideration and if they will take it, they will add it in a database and they will send it to Ireland and then, Ireland will have 70 days to respond and take actions........Sooooooooooooooooo a lot of back and forth to see the wife cause we are without a passport and she can't move from the country.

This topic won't stay open for ever to become yet another long running crossover topic for different applications. You will need to start your own topic again for the next process based on your circumstances or look for one of the existing topics we already have on this next process.
