What happened if over the absent days?

Post by kyk00525 » Sat Mar 18, 2023 3:06 pm

One friend spent all 42 days or just 40 days if the two days don't count last year to his home country as he was been told is based on the calendar year(the rule).
And he made another one week trip to Spain this year already . So he is now 45 days in total.
So what if he consider naturalization in the future . Does he need to stay more 3 days or 42days? Or even one year?
This is the first year stamp4
Visa Period is may to may

If he's 45 days over - 5 years + 45 days in total.

In this regard, it is considered, that a reasonable and generous period of up to 6 weeks be allowed to provide for absences from the State for normal holidays and other short term and temporary nature absences, such as for business meetings or a family wedding or bereavement or medical emergency while abroad, and that such short term nature absence from the State would not impact on the statutory residence requirement. However, in the absence of any additional information in relation to extended absences, absences totalling 6 weeks or more in any year will be deducted in their entirety from the reckonable residence in the State.
It also seems to be counted per calendar year, so check your calculations. He might be fine as is.

It's unclear indeed.
They can be on the safe side then and add 45 days to their necessary census for naturalization.
