Dear all,

I am an EU national and planning to move to Ireland with my non eu husband, what is the first and step to do when we enter Ireland? Is it correct we need to go to the police station to declare the will to stay in Ireland for my husband in order to get a IRP (to prolong the permission of stay) and later apply stamp 4 under EU treaty right to get a permit to work and stay? I am confused right now about the IRP and stamp 4, thank you for your answer in advance.

If your husband needs a visa to enter Ireland, he needs to apply for a Type C visa first in your country's Irish embassy.

Once his visa is approved, or if he does not require a visa, he can travel to Ireland. You can choose to travel with him together or you can travel here first. Upon his arrival in the airport, he needs to show the immigration officer your marriage certificate and declare that you intend to exercise EU Treaty rights.

You then get your documents ready - bank statements, rental agreement, employment letter, insurance letter etc, complete the EU Treaty application form, and send them to INIS/ISD. They currently allow applicants to scan and email them the application instead of physically mail them in, but it's just a temporary measurement due to Covid-19.

Once INIS/ISD gets your application, they will give your husband a temporary permission. You both then take this letter to your Burgh Quay or local Garda Station so that he can get a temporary IRP card. Again, at the moment due to Covid-19, he will not be required to do this.

In around 6 months' time, he will get a final decision letter and you both take this letter to Burgh Quay / local Garda station again to get a final IRP card.

Thank you Littler, the picture becomes more clear now. My husband does not require visa to stay in Ireland for 90 days, so we must send the application to INIS within 90days to get the temporary IRP, how long does this take to get the temp IRP? My husband requires a proof of residency entitlement to exchange his uk driving license to irish one, is it possible to use the temp IRP as an induction? Thank you for your reply.

I think the temporary permission letter should arrive within a few weeks, although I’m not really following INIS’s service timeframe nowadays.

Once he obtains the IRP card, he can apply for a PPS number (for tax purposes). With the PPS Number and IRP card (and proof of address like a bank statement) he can exchange the driving licence.
