Job Advertisment for unrestricted COS

Post by sole_searcher » Sun May 17, 2015 3:21 pm

Hello,
I am currently on Tier 4 visa and have been offered a job by a UK employer who is registered with the Home Office as a Tier 2-General (A rated) employer. I was recommended to the employer by somebody who currently works in the same company, the employer interviewed me and after that made a verbal job offer. I was the only candidate interviewed for this job role. I will be joining the company after my exams in June and I will get my degree certificate in July when I will be able to apply for the Tier 2 General.
I believe that my employer will be issuing the unrestricted COS to me so that I can get Tier 2 General Visa, I have the following concerns:
1) In order to fill the job vacancy using unrestricted COS, do the employer need to advertise the job, if yes then where and for how long? Are there any guidelines?
2) I was the only candidate interviewed for the job (as the job was not advertised yet and I was referred by an existing company employee as soon as the vacancy became available). Could this be an issue for me and the employer?
3) Is it OK to join the company before getting the unrestricted COS from the employer. I am allowed to work 20 hours/week for now until my university term finishes?
I am really stressing out about the above, I will appreciate if somebody can shed some light on my above queries.

As you are currently on Tier 4, your are exempted from the RLMT - no need for specific adverts etc... as long as you are graduating with a degree (ACCA doesn't count). Not an issue if you were the only one who interviewed.

You can work the hours specified by your Tier 4 until you switch to Tier 2.

there is an exemption from the RLMT for those switching from T4 to T2G - see the T2 policy guidance

no, see above

you are only allowed to work at present as permitted by your T4 leave conditions

I am really stressing out about the above, I will appreciate if somebody can shed some light on my above queries.
