Post by mohdtammam » Sun Aug 02, 2009 2:22 pm

Hello all,
I have just got the settelment visa :D and i wanted to travel to the UK but i'm not sure that i can stay for a long period continuously.
i was wondering is it imperative or optional to stay for a month maybe and then leave the UK for my country for 3 months and after that travel to the UK again for a month perhaps...... is (beeing outside the UK for long time) affect in anyway my visa status or my following steps ..getting a permanent visa after 2 years ??? British Passport maybe????
thanks

If this is what you want to do ,why come to Britain in the first place?.

The whole purpose of settlement visa is that you come to settle in the Uk permantly. If you keep coming in and out you could possibly be refused permanant stay when you apply for your ILR as you could not show that you have intention to settle in the UK.

You can do what you stated in the post, but expect problems in the future.

If you want to come in and out of UK , you are better off with a visitor visa, then you can come and go as you like.

thank you batleykhan for your reply,
well i don't want actually to do this in and out all the time during the 2 years, it's just i got a difficult situation that i can't leave my current job before January 2010, so my plan is :
as my wife at the moment is with me for a month in my country of residence, after that i will be leaving with her for the United Kingdom for 10 days and after that staying in my country for a month and after that i will be leaving for the UK for nearly 2 months and after the Christmas i will settle permanently inshaAllah, although i may take a week vication after my permanent settelment every six months without fearing or expecting trouble.
so if i do what i am planning to do, do you think after the 2 years they will grant me the permanent visa ???

First of all, you could have asked the ECO to post date your visa to start from Jan 2010,and it would not have caused you any problem.

However as you have failed to do that, you have to do what you have stated in your post now.

Whilst the rules allow people to be absent for some time out of the UK,before you apply for your permanant visa, it depends how long and how many times you have been absent.

Most peoplel get permanant stay but some are refused ot asked to reapply for further leave to remain till you have completed two full years as per the requirements of ILR are met.
