I was hoping someone might be able to give me some advise on our situation. I'm an NZ national with an English girlfriend and we have been a coupe since Nov 02.
I entered the UK in Sept 1996 on a 2 yr WH visa and while here during that time I met and married an Italian national. We continued to live in the UK and through the home office I was granted a visa to stay as a European dependant, this was valid until 2004.
We separated in 2001 and I remained in the country due to my work. I met my current partner at the end of 2002 and in December 2003 we left the UK and she got working visa's for Australia and NZ.
She returned to the UK at the start of this year and is currently doing teachers training. I am currently in the UK until December on a vistors entry and we would like to apply for permenance residency. What avenues (if any) are available to us at this stage?
I have not gotten a divorce as yet, however have spoken to my ex and it has been agreed that I will file proceedings in NZ court when I return in December, as neither of us now reside in the UK.
